Show TWO SUITS ARE BEGUN . AGAINST D. H. MOFFAT OVER PLEASURE RESORT NEW YORK, Nov. 24. The suits filed In Jersey City yesterday against David H. Moffat, the mining and railroad rail-road millionaire of Dener. grew out of Investments made In a pleasure park at Chesapeake Beach, Md., Charles Myers, a wealthy hotel owner of Atlantic At-lantic City, the complainant, brings the suits as an executor., through Lawyer E. B. Learning of San Francisco. Several years ago Charles R. Myers, his brother, the late John Mjrers. and President McCracken of the Camden Central Trust company secured a leaae hold on the land and expended (120.000 In Improvements at Chesapeake Beach with the Intention of establishing what was termed at the time an American Monte Carlo and pleasure resort. Venture Not a Success. ' A charter was secured in the Maryland Mary-land Legislature. Owing to poor transportation trans-portation facilities the venture was not a success. The property "was afterward after-ward sold at what was alleged to be a tax sale and went to David H, Moffat. The taxes amounted to about $400. No notice of the sale had ever been given to Myers, he asserts, and he claims that his interest was under a lease hold and he should not have been liabje for the taxes and that they should have been paid by the owner and could not affect his interest. Moffat Holds Possession. Moffat continuing to keep possession, Mr. Myers brought suit to recover damages and the (120,000 expended for the Improvements to the land, together with interest and damages. For months attempt has be in made to get service of papers on Moffat in New Jersey, Maryland and New York. The park is located about thirty miles from Washington, D. C. Mr. Moffat is at the Fifth Avenue hotel here. He refused to d truss the case last night. |
