Show Alleged Contract Between Lincoln Highway Association and State o of Utah Citizens In Citizens In ens In Your Your Opinion Is 1 This or Is It Not a Valid Contract b and What Should Be the tile Action of the State of Utah Regarding Same If the Lincoln Highway Association Has Completed Its P Part of the Contract Answer Lincoln Lincol 1 Highway Association Newhouse Hotel City Y WHEREAS WHEREAS The Lincoln Highway Association a corporation organized under the laws Jaws of ot the State of ot Michigan with its principal office in Detroit Michigan has made certain offers to the State of ot Utah for the advancement of sums of ot money aggregating for tor the completion of ot two sections of ot road one between Clover and Orrs Orr's ranch Utah and andone one between the north end of ot Granite Point and Black Point Tooele County Utah and AS It Is agreed that in constructing these two necessary links in the route selected and thereby dominating some 50 miles of the worst road conditions now existing on the Transcontinental Highway the Utah tate State Road Commission will accomplish a work of the greatest benefit not only to the State of Utah butto butto but butto to the United States in linking this great national strategic highway with its r resources and its people to the states on the east and west and to the Atlantic and Pacific coasts thereby complying with the recommendations of ot the National Council of ot Defense In bringing the Utah section of ot the Lincoln Highway Into proper condition and We Wo see in th this s construction now more than ever before the keystone key key- stone of the Lincoln Highway arch the most necessary step to b bo be taken to provide provide pro- pro vide a through route of ot an American highway tr transportation system and 1 WHEREAS Through our patriotic desire and support we believe that this construction will provide the only immediate opportunity for the Lincoln Highway Association and the State Road Commission of ot Utah to cooperate In achieving a result of ot vast national Importance and WHEREAS The State Road Commission of ot Utah is willing to accept the money tendered In consideration of ot the fact that the said State Road Commission shall be allowed to make the construction requested and required and In n full compliance with the general road policy of the State of ot Utah A NOW THEREFORE BE IT RESOLVED By Dy the State Stat Road Commission of the State of ot Utah In regular meeting assembled this day of March 1918 that the offer of by the Goodyear Tire and Rubber Company and by Mr F. F A. A its President for the construction of ot that part of the Lincoln Highway hereinafter particularly described wit to-wit COMMENCING CO AT POINT IN TOOELE COUNTY UTAH known as the tho north end of Granite Point at Granite Mountain thence in a westerly direction J for a distance of ot approximately 17 I miles to a point Known as Black Dlack Point in Tooele County Utah which said points are the termini of the shortest distance across what is known as the Great Salt Lake Desert be accepted and a a. roadway be constructed not less than eighteen feet In width and not less than one foot in elevation of natural dirt soil soli covered with a a. gravel grave surface of ot not less than eight Inches In depth at the center nor less than twe twelve ve feet teet in WIdth i or of ot greater width if it so determined by the State Engineer of ot Utah upon upon further investigation also aIso B D BE DE IT RESOLVED That the tho otter offer of 00 from 1 Mr Ir Carl G G. Fisher for tor the construction of ot that portion of ot the Lincoln Highway from Clover Tooele County Utah toward GIT'S GITS ranch via what Is known as 88 Johnson Pass be ac- ac Said Is to be used in constructing ting a safe sate mountain highway with track double turnouts with suitable bridges to be erected where needed the funds to be applied where most moat necessary sary as Indicated by sold said State Road CommisSion Commis- Commis I eion Sion lon after Investigation and recommendation by the State Engineer said construction tion to cover cover- a distance as may be determined upon further investigation but in no case shall said funds be applied on a a section or sections the total construction exceeding exceeding ex ex- six Elx miles in length C The condition upon which said money Is tendered to the State State- of Utah and accepted by it to be that mid said road for tor the entire distance below Clover Clovel Utah and the tho Utah-Nevada Utah State Line via Overland Canyon shall be designated as a state 1 highway by the State Road Commission on or before the date that construction construction construe tion shall actually begin thereon the State of Utah first having secured proper right of ot way where such construction Is to be made i D FURTHER That a a. road connecting the west terminus of ot the section and the present road through Overland Canyon shall shaH be opened up and made passable for tor propelled motor vehicles by the State of Ot Utah and that a road from Johnson pass at the end of ot the Fisher construction and west to Granite Mountain be put In good passable condition for far travel In order to connect the SI Fisher memorial sections Also that a connection be made by the State of Utah between the last terminus of ot the Fisher section and the town of ot Clover Utah E There shall be deposited with the tho State Treasurer of ot the State of ot Utah as an evidence of good faith by said and said Fisher on or before the 1st day of ot May 1918 or by the Lincoln Highway Association as their representative fifty per cent of ot the gross amount therein appropriated and the remaining fifty per cent shall be likewise deposited on or before the time when actual construction work shall have been commenced F Said work shall be continued and completed not later than the first day of ot July 1919 G The providers of ot the funds herein referred to and hereby accepted by the State of Utah shall be furnished with duplicate copies of ot the disbursement sheets J. kept In the office of tho the State Road Commission of lOt Utah showing howing the application i of ot said sald money and the detailed items of ot expenditure as the tho work shall progress Which said statement shall be furnished monthly The desert section herein referred to shall shaU be known and designated either as I the Goodyear or section as Mr fro F. F A. A shall hereafter determine and end Johnson Pass shall hereafter be known and designated as Fisher Pass or b by i such uch other designation as Mr Carl G G. G Fisher shall hereafter determine I Said d and Fisher are hereby given authority to construct at their own I expense at the termini of ot or at such other places along such sections suitable markers monuments or arches for the the- designation of said respective sections In connection with the work herein referred reten-ed to The Lincoln Highways Highway's representatives are hereby given authority to Inspect the work on said 1 highway while the same shall bo be in progress of ot construction under the direction of the State Engineer and the State Road Engineer respectively i FURTHER Said section after atter completion shall Shan be kept closed to all i travel until officially dedicated Jointly by the officials of ot the State Stat of Utah and of the said sald Highway Association In Jn consideration of ot the construction made by the State Stat of oC Utah whereby the Fisher and sections are connected with an and made a pari part of ot the State Highway system of Utah it is agreed that Mr r. r F.
