ii U. U S. S Judge Inspects Magna Ar Area a Involved ved Tailings in Dust Suit Looks Over Vast Dump With Attorneys on Both Sides of Case Federal Judge Tillman Tiliman D D. Johnson Tennessee born seemed more like a show me Missourian Tuesday as he hc made a personal inspection of the Magna area in the tailings dust suit against the Utah Copper company The point of his trip was the acre tailings dump north of the mill For more than a week controversy has swirled in federal court as Magna residents sought sough to have the company enjoined from depositing any more tailings on the dump and ordered to remove the dump now existing The plaintiffs have maintained that dust from the dump damaged their homes property and health and if no injunction is possible they ask the court to fix damages The company has contended that granting the injunction lJ wo would ld necessitate closing all operations at Bingham Bingham Bing- Bing I ham and the Magna mills Counsel for the company have maintained that the firm cannot control the dust but that there is no dust except except ex ex- in periods of extremely high wind and even then it it itis is n no more disagreeable or damaging than ordina ordinary na nary y dust Judge Johnson wanted to find o out t for himself so Wednesday accompanied accompanied by counsel for both sides in inspected inspected inspected in- in the area involved What he found foung l no on one wm Will will know until his decision is h handed hd d down down
