Peoples Peo-ples Municipal Central Committee to attend tie hearing of the charges filed by that committee against the registrars of time city Mr Moyle suggested that Mr LeGrand Young another of the attorneys for the committee would bedetalned In the District Court a short tme and that if lie Commission had other business busi-ness before I I would b agreeable to his side to continue thorltmn hearing n short time hcrlg tle Col Paige her announced that he had just been notified hI tele phone that Registrars Morris and Clute would bn wanted the District trict Court at I oclock At Gen McCIernands suggestion the Commission Com-mission held a brief consultation when it was decided to go on with the case of Mr McCnIIum On lnliilf of this defendant Mr Dicksou read an answer containing denials of come of the allegations the complaint alt versions of some of the facts therein stated at variance vari-ance with the statements of the complaint The CommiMiou ruled that i would take up had been admitted ad-mitted to citizenship o many years ago and had I voted many years Registrar McCallum had shown I him his name mkti lleil on the registration t nnd hat refused 1 to correct It Witness thought this occurred two or three months g Mr Dicksou objected to this testimony for the reason that the incident occurred before Mc Calluni was a registration officer The defense showed witness affidavit affi-davit to the effect that the incident occurred early In November and also cited the fact that McCalluma answer confessed the circumstance WUnesx was allowed to state the conversation which occurred and on crossexamination said that e alum told him he must apply to the county clerk to have lib name spelled correctly and refused t reregister register him Witness oc-curred in McCalluma private ofllce while he was making his house to house canvass and was not obliged to register applicants at his office Mr Moyle replied that the incident inci-dent showed discrimination by the ofliccr In registering one man and refusing to register another Mr Jack hind gone to the office in company com-pany with a well known iiimibernJs Jake Greenewaldand was office and he could not r gfcUr any of them there A man named Smilh stepped up and asked dk to et registered McCallum said he was going away for a few days when te < alum invited him into the office and then anil there registered reg-istered him Smith seemed t lie a stranger to McCallum Witness b lieved Smith to be a member of the MornionChurch all of the Peoples Peo-ples Party but thought he toos no part in Church matters Joseph Woolsey net testified He lived at U S Third East Street Had apple In the latter part of November t McCallum to be registered I was at the St James Hotel taw him register one or two men when witness aILed to be registered regis-tered giving i his name McCallum refused to register him saying that witnesss wife had told him Mc Callum that witness had come t Salt Lake t vote McCallum b came angry and threatened list if witness registered he would have him in thu penitentiary within twentyfour hours On crossexamlnaUou witness said lie came t this city in September from ICanosh was born In Provo L rll bl had lived in Kanosh seven or eight years voted In ICanosh test Augustowned t no property liens Came t Salt Lake because he heard there was work here ha J no recommend recom-mend from his lilshop to come was not advised by his Bishop to come knew nothing of other residents of Ivauosh who had come here Had been In the house where he now lived about one month before his wife came eight men besides himself him-self lived there and had been living here about three or four weeks b fore the registration officer called some of them came from ICanosh Mr Moyle objected t this line of cnnscxamlnaUon as i related t other men for whom witness was not responsible Mr DIckson held t was proper a showing that witness wit-ness was one of 1 pry who hid come to this city for an illegal purpose pur-pose a fact that would atlecthls testimony The point was argued by counsel pro and con and the Commission after conferring ruled that witness might he l > questioned as for as necessary to inquire Into his good faith In coming t this city This virtually gave Sir Dickson all the grope he desired and he con tluutd the cross examination eliciting Wit new wife kept bouse for the men staying there Witness obtained work from Mr Watson on the te sewer had no cenversaUon with Mr Watson about politic Mr Moylo objected t quertions touching witness work as Irrelevant Overruled Witness did not know Watson came to ask him for work because he had been told he a I boss on the ecwer had inquired of 1 workman work-man who the bcfes WB did not know who occurred curred at the time be applied t Mc Callum for registration but nothing Important was elicited and witness was excused Mr Boyle asked If the Commission Commis-sion issued subptenas and received a negative reply C J Walquist was next sworn On D 10 witness made several attempts find McCallum Was In the hatters office when he came in McCallum said he could II cCalum cul not register him there but would call at his witness house Witness plied that the neighbors had told him that the registrar had already inssetl lib house McCallum then said ho could not register witness until Dec 23 Crosirexamlncd by Mr Dickson Witness was unmarried lib parents lived In Wasatch County had been working I for a man living In Silt Lake and came here to get his money concluded he might as well McCalium stated during his testimony that he considered I his duty to closely question applicants for registration whom ho nil not know concerning theIr qtialifica thousand to refuse to administer when the examination of Mr McCallum a resumed In reply tb Mr Dickson witness named two Liberals whom he had refused t regker before Dec 2 but admitted on crossexamlna ton that neither demanded t be licdll know him Witness heard all the conversation on that occasion The case against MtCallum was temporarily laid aside owlnglo the absence of witnesses and that against I D Winters was begun John A Hamilton was sworn Had lived In the Fourth Precinct nearly four re called at Mr Winters oflice on Novembci 30th six I times and again on the next Monday when he met Winter ou the stairs He asked t be Ilrlte to see If his name was on the list Winters replied thai the I registratlonwas closed but that checked witness Ime was on lie list and Chairman Godfrey asked I W Young If be held that the registrars after finishing their house to house canvass were under obligation t keep their books open till the thin 1 week In December MrYoun te piled 4tYes for tbe reason that only a very few voters were at home when the registrars called Chairman Godfrey remarked that were this done there would not tie money enough In the Territory t pay the lr that the other members of the Commission might speak for themselves but he did not care t listen t any more testimony testi-mony on Uils point At thisjunctureMr Dickson read Mr Winters answer t the charges made against him iu which the name of Mr Moyle was mentioned as Ions trying t control Winters ac tons Mr Moyle took the stand He and W C Burton bad waited on Mr Winter and told him that many voters of lie Peoples Party desired to b registered and I he would name a time when he would visit n I given district they would JjQnuin at home Winters promised that on that afternoon he would commeme ou the north tier of blocko In the Fifth Bishops War when whIm Band B-and Mr Butlou said they would notify their friends t be at homo i Mr Winters made this proposItion freely Witness could net say except ex-cept on information whether WIn era had done as he proposed Mr Moyle asked that the affidavit evidence of an absent witness 0 receivedIn Chairman Godfrey said I might bei n bad precedent to admit I an affidavit Mr Moyle said I that as there was no authoritative means securing attendance of witnesses nesses his side were meeting with much difficulty In getting their evidence before the Commission Chairman Godfrey said reasonable time would 0 given Mr Moyla to secure the attendance of bit witnesses wit-nesses Mr Woods was here sworn and testified t the registration of Wm T Jack and the refusal of Mr rc Callum t the fine to which an adjournment adjourn-ment should bo taken At length pm tomorrow was fixed upon upn and the Commission adjourned |
