Show v - ORDINANCE AN ORDINANCE AMENDING SECTION 85 OF CHAPTER 15 OF AN ORDINANCE OF SPRINGVILLE, UTAH, AS PASSED BY THE CITY COUNCIL COUN-CIL OF SPRINGVILLE, APRIL 1, 1931, RELATING TO CLOSING HOURS' OF CAFES, ETC. BE IT ORDAINED BY THE CITY COUNCIL OF SPRINGVILLE, SPRING-VILLE, UTAH. SECTION 1. Section Amended. That Section 85 of Chapter 13 of an Ordinance of Springville, Utah, passed by the City Council -of Springville, Utah, on the 1st day of April, 1931, " relating to closing: hours of cafes be and the of the ordinance passed by the City Council of Springville, Utah, on the 6th day of August, 1945, entitled: "An Ordinance Amending Section 85 of Chapter 13, of an Ordinance of Springville, Utah, as passed by the City Council of Springville, April 1, 1931, Relating to Closing Hours of Cafes, etc." IN WITNESS WHEREOF, I have hereunto set my hand and affixed the corporate seal of the City, of Springville, this 6th day August, A. D., 1945. GLENN HANSEN, City Recorder same is hereby amended to read as follows: SECTION 85. Closing Hours. It shall be unlawful for the owner, keeper, manager of, or employees, in any cafe, restaurant, or any other place where meals, hot dogs, lunches, or other refreshments are served and where, in any of the , aforementioned places beer is sold, dispensed, given away, or delivered, deliver-ed, to allow or permit such places of business to be or remain open, or-to conduct business therein between be-tween the hours of 12:00 o'clock P. M. of any day and 5:00 o'clock A. M. of the following day. That any cafe, restaurant, drug store, confectionery store, or any similar simi-lar place where meals, lunches or other refreshments are served and which do not sell,- dispense, give away, or deliver beer, may remain open continuously; provided that such places of business are conducted con-ducted in a proper and orderly manner and in such a way as to not disturb the peace or to create a nuisance or to annoy unnecessarily unneces-sarily the adjoining property owners own-ers in the peaceable enjoyment of their premises; provided further, that music boxes, loud speakers, or any type of mechanical instrument in-strument for the production of music or advertising purposes shajl not be used between the hours of 11:00 o'clock P. M. of any day and 8:00 o'clock A. M. of the following day; provided further, that no employee, either male or female under 21 years of age shall be employed in any of the places of business in this section sec-tion before mentioned between the hours of 1:00 o'clock A. M. of any day and 5:00 o'plock A. M. of the same day; provided further, that a violation of any of the terms of this section shall be sufficient cause for a summary revocation " of the license of, the violator or I a restriction or limitation as to the time such place or places of business shall remain open or may conduct business therein. This action ac-tion to be in addition to the penalty pen-alty provided for in this chapter for violating the terms of this chapter. SECTION 2. In the opinion of the city council it is necessary to the peace, health, and safety of the inhabitants of Springville City that this ordinance become effective effec-tive immediately. SECTION 3.. This ordinance shall take effect at once upon its passage and first publication. PASSED by the City Council of Springville, Utah, this 6th day of August, A. D., 1945. EMTL OSTLUND, Mayor.
