Show LEGAL LEGAI fax ax on transitory herds ilo bow tv it works attorney general bishop has rendered an opinion in answer to a question from D H morris county attorney of washington county in which he says dear sir I 1 have your favor of the alt in which you refer t to 0 an opinion rendered by this office in marh marh of it this year relative to the apportionment of taxes collected on transitory herds the opinion was to the effect that one half of the taxes which are imposed by the action of the county commissioners ners should bo be remitted to the county entitled thereto in cases to which you refer it was hold held that the county school tax should be considered when making the apportionment it seems that tho the county to which you refer has remitted a certain amount but has not remitted the amount of the county school tax which is ia due your county on account of transitory herds for the reason as claimed that the taxes r so ro o collected had been placed at the disposal of the school district and hen so 0 o beyond its reach you ask for a supplemental opinion as follows will you kindly give me your opinion as to how the money in such cases can be legally drawn to pay claims I 1 suggest that your county make a demand upon the county to which ch you refer for the balance remaining unpaid it if it has placed the funda fu ds specific funds beyond its reach it is nevertheless liable for the unpaid balance and I 1 am of opinion that it would be the duty of the commissioners of that county to remit the amount due your county in the premises and that they would be entitled to reimbursement at the hands of the school district to which an amount has been paid greater than that to which it is entitled |
