Show NOTICE OF TRUSTEES SALE whereas william alexander ches ley and matilda chesley his wife did by their certain deed of trust dated the day of december 1891 and recorded the day of december 1891 in book 8 page of tho records ia the office of recorder of deeds ot counte in the territory now state of Utah convey to william H dale as trustee the following follow inc described real estate situate in said utah county wit commencing 24 chains north of the southeast corner of the southwest quarter of section nineteen 19 township six 6 ot range three 3 baet salt lake meri dho thelca gunnine north 83 degrees 20 minutes west 26 ga chains thence north degrees east 1075 chains thence south SS degrees east 22 50 chains and south 10 chabina to the place of beginning also at tha northeast corner of the southwest quarter said section thence south 6 chains thence north degrees west 22 50 chains thence north 4 degrees west 5 44 chains and thence east 22 59 chains to beginning also commencing com at the southeast corner of the north west quarter aard thence south 88 degrees 30 minutes 16 72 chains north 4 degrees 15 minutes west chains hence north 88 degiers 30 minutes east 16 93 chains and thence south 1 degree east 3 61 chains to beginning containing in all 43 59 acree including with said land all the ditch and water rights which were owned by the avd william alex ander chesley and matilda chesley at the date of said deed of trust or which was acquired by the said Ghee leys and used in connection with said land which said conveyance waa made in to secure to the order of the lombard investment company the payment of tho eaid william alexander cheshev and matilda Chee leys one certain promissory note of even date with said ceeil of trust for the principal sum of fourteen hundred 1400 dollars due aud payable january ast 1st 1897 with interest thereon from date thereof until maturity at the rate of six 6 per cent per annum payable semi with interest thereon after maturity at the rate of twelve 12 per cent per annum payable eema annually and whereas it is provided in said deed of trust that in case ot default in the payment of eaid promissory note or the interest thereon or the taxes on said real estate the trustee shall upon the application of the legal holder of said note sell and dispose of said premises and all the right title benefit and equity of redemption of the said williana alexander chesley and matilda cheshev Che their heirs and assigns therein at public auction at tho place in the manner and for the purposes in said deed of trust stated after first giving thirty SO days notice as particularly provided lor in said deed of trust re ference to which is hereby made for greater certainty and whereas default has been made in the payment of said principal note of 1400 and in the payment of six 6 coupon interest notes of 42 00 each due july ast 1st 1894 january 1895 july lat 1895 january let 1896 july lat 1896 and january ast 1st 1897 respectively ively and in the payment of taxes for the years 1895 and 1890 amounting to the sum ot anich said amount of taxes has been advanced by the leeal holder of said note and the said principal note coupon interest notes and taxes are still past due and unpaid now therefore notice is hereby giyen that I 1 the undersigner undersigned under signed trustee as aforesaid at tha request of the leeal holder pr note and under and by virtue of the power and author auy in me vested by said deed of trust will on the day of may 1897 at the hour of three 3 in the afternoon of the said day sell the above described property and all the richt title benefit and equity of redemption of the said william alexander chesley aul fl latilda chesley their heirs and therein at public auction for the highest and beet prica the same will bring in cash at the front door of the county court house in provo utah county utah for the purpose of ra ing said principal note coupon iu terest note sand taxes and all costs at d expense of this trust WILLIAM H DALE trustee first publication april last publication may 27 1897 |
