AN ORDINANCE to for the graveling of the sidewalks in graveling districts no 1 no 2 and wo 3 SEC 1 be it ordained by the city council of provo city that the three sidewalk graveling districts heretofore established by the city council known as graveling districts no 1 no 2 and no 3 come within the purview and meaning of this ordinance the boundaries of said districts being as follows the sidewalks on J street from first to fifteenth street street from A to 0 streets and E from first t street comprise district no 1 K L M and N streets from third to fifteenth street and all streets running east from J to N street comprise district no 2 all streets running anerth and south J and E streets and all streets running east and west from first to both inclusive except seventh street comprise district no 3 SEC 2 A tax not to exceed six thousand dollars is hereby levied on the real estate lying and being within the limits of said sidewalk graveling districts for the of with mountain gravel and otherwise repairing the sidewalks in the named districts SEC 3 the assessment for graveling purposes shall be according to the front red or fraction thereof ab buting sidewalk to be improved and the amount of assessment shall be calculated on each red of sidewalk according to the estimated need thereof provided that tha aggregate tax shall be within the limit herein named SEC 4 the city recorder or his deputy shall list and assess the property according to the provisions ot thi ordinance stating alie name of the owner orf if unknown then so stating and giving the number of lot and block and name of plat and number of rods or fraction thereof of each lot and piece of ground fronting the sidewalks and the amount of of tax levied thereon SEC 5 after tha list is made up and the assessment approved by the city council notice shall be given in some newspaper of the completion of said list for not less than five consecutive days and from the date of the first publication of said notice and during the tima specified therein the said list shall be open to public inspection spec tion and any person or persons feeling themselves aggrieved shall have a hearing before the said council notice shall be given of the time when the city council shall sit hear grievances vences and complaints of errors iu assessment SEC G the supervisor of streets is hereby constituted the collector of the tax assed by this ordinance upon tho receipt by him of the corrected tax list he furni sli to each property taxpayer owning real estate within the said sidewalk graveling districts or leave at his residence or usual place of business or mail to his address is known or notice of alie tax assessed against him and when and where payable and when delinquent and what proportion thereof may be paid in gravel and when the said tax is due he shall proceed to collect alie assessment and to enforce the payment of such portion thereof as may become delinquent in alie manner provided by the laws of tho territory and the ordinances of provo provo city for the collection of the city general tax SEC 7 the city supervisor of street shall be responsible on his bond for the faithful performance of his duties as collector of any and all assessed and collected under the provisions of this ordinance SEC 8 all taxes assessed under the provisions of this ordinance shall be dua and payable on the third day of december A D 1895 and any and all taxes remaining unpaid on the first day of april A D 1896 shall be deemed delinquent SEC 9 the tax assessed under the provisions of this ordinance may be paid in whole or in part in mountain gravel at the option of the taxpayer at the rate of fifty 50 cents per load of not less than one cubic yard delivered on the sidewalk where the same is to be used passed this ard 3rd day of dec A D 1895 jos B KEELER president of city council attest JOHN D DIXON city recorder approved this ath day of dec A D 1895 LAFAYETTE HOLBROOK mayor of provo city TERRITORY OP UTAH s UTAH COUNTY s provo city I 1 john D dixon Hc corder in and for provo city utah county and territory of utah hereby certify that the foregoing is a full true and correct copy of an ordinance entitled an ordinance to provide for the graveling of tho sidewalks in graveling districts no 1 no 2 and no 3 passed by the city council of provo city december ard 3rd A D 1895 in testimony whereof I 1 have hereunto affixed the seal of j SEAL provo city this ath day of december A D 1895 JOHN D DIXON city recorder
