book 17 of trust deeds oc page of the records of said recorders office which said deed of trust was given to secure to damon G of the county of mcdonough and state of illinois the payment of certain therein described to wit one first mortgage bond or promissory note bearing even date with said deed of trust for the sum of twenty one hundred dollars payable five years from the date thereof to wit on ane first day of august A with interest from the date thereof until paid at the rate of nine per cent per annum payable semi annually which said interest was evinced by ten interest notes attached to said principal bond or note for the sum ninety four dollars and fafty cents each payable respectively on the first days of february aud august during each year from the date of said principal bond or note and until the expiration of five years from its date jall of said notes were signed by said alfred labooth LB john E booth and delia I 1 booth his makers were all of even date with said deed of trust and were all payable to the da mon G and said principal bond or sole provides that if any interest remains unpaid thirty days after due the principal shall become due and collectible at once at the option of the holder without further notice and shall bear interest at twelve per cent per annum after maturity and all of said notes are payable at the american national bank salt lake city utah with current rate ot exchange on new york cita in eold or ita equivalent bald deed of trust is upon the following described land and premises situated in the county of utah in the late territory now state of utah to wit commencing five 5 feet bouth of the northeast corner of lot eight 8 in block 67 plat A city survey ot building iota in section one 1 township seven 7 south of ranee two 2 east salt lake meridian chenco south with the line of said lot twenty two 22 feet thence west eix 6 rods thence north twenty two 22 test thence east parallel with the line of said lot to the akca of begin inc containing eight 8 square rods together with all the tenements heredi ta ments privileges and appurtenances thereunto belonging together with all water rights owned by said granfors grantors gran tors id said deed of trust ox either of them belonging to or need with or on eaid premises prem ipes or any part thereof and it is among other things provided in said principal bend or note that if any interest remain unpaid thirty days after due the principal shall became due and collectible at once without further notice at the option of the holder and it is also provided in eaid deed of trust that aard granfors grantors gran tors therein should pay all taxes levied or assessed against said premises aad they did therein covenant and agree io pay the same and it is also in said deed of trust provided amona other things in substance and to the effect that in case default be made in the payment of either of bond notes indebtedness or moneys aforesaid secured by aard deed of trust or the taxes or assessments therein mentioned or in case of the breach of any of the covenants therein contained to be kept and ner formed by said granfors grantors gran tors in said deed of trust then said trustee or his successor in trust shall beell and dispose of eaid premieres premi ees or any part thereof and all the right title benefit and equity of re demotion demp tion of said granfors grantors gran tors in said deed of trust their beira and assigns therein forever at public auction at the front door of the court house in the county of utah in tho then territory now state of utah or on the premie ea or part thereof aa might be specified in the notice of such bale for the highest and beet price the same will bring in cash thirty days previous notice of such sale having been given by publication in any newspaper published in said county of utah or if no newspaper should be published in said county then in the nearest newspaper published in the then territory now state of utah it Is also provided in said deed of trust that in cabe of the death of james H bacon or of hia absence from the said utah county or in case of his inability or refusal to act as such trustee then H M bacon or F L holland are by said trust deed appointed and made successors in truet to said james H bacon with like power anil authority for the uses and purpose aforesaid and WHEREAS the said james H bacon is absent from eaid county of utah and is unable to and has refused to act as dueh trustee and WHEREAS tho said alfred L booth john E booth and delia I 1 booth haya each made default in the payment of the interest notes which became due and payable on the first day of february A D 1895 and on the first day of august A D 1895 and in the payment of the taxes on said premises for the years 1894 and 1895 respectively and allowed eaid premises to be sold for the nonpayment non payment of said taxes for the year A D 1894 all 0 which said interest except the sum of ten dollars which wag paid on said interest note which fell due february first A D 1895 remains unpaid as well as said taxes aforesaid and WHEREAS eaid damon G the legal owner and bolder of said principal bond or note and of all of said interest notes which have not been paid hag by virtue of the power and authority in him vested in and by qaid principal note or bond and in and by said deed of trust elected to and has declared the whole of said principal bond or note to be immediately due and payable and has re quested the said trustee as weil as aard successors in trust or one of them to proceed to advertise sell and convey paid premises and water rights pursuant to the terms of truet deed and for the uses and purposes therein mentioned now THERE I 1 HM bacon as one of the successors in trust as aforesaid tha eaid james H bacon as trustee being ab sent from said county of utah and being unable to and having refused to act as such trustee at said gale hereby give public notice that I 1 will on the day of february A D 1896 at 12 noon of raid day at the front door of the court house being the north door oe the county court house in the city of provo in the county ot utah in tho state late territory of utah then and there offer for sale and beell at public auction to the highest and best bidder for cash in hand tho said premises hereinbefore described bed with the tenements here dit amente privileges and appurtenances thereunto thore unto belonging and any and all water rights owned by the grantor in said deed of trust or either of them belonging to or with or used on said premises or any party thereof for the purpose of paving eaid principal bond or note and the eaid interest kotce past due and unpaid as aforesaid and all interest earned on said indebtedness up to raid day of sale which at that time will amount in all to the eum of and for any taxes or assessment or to redeem premises from tax sale or sales thereof which may have been paid by the holder of said indebtedness up to said time of eale but if nono has been HO paid then said sale will be mada subject to any taxes that may remain unpaid on said premises and also subject to any eale or sales that may have been made of said pramis eeor any part thereof sinco the execution of said deed of trust tor the nonpayment non payment of taxes thereon said eale will also be made not only for the purposes hereinbefore
