Show NOTICE OF TRUSTEES BALE whereas benjamin W driggs and olivia P driggs hia wife as party of the first part executed and delivered to james H bacon trustee as party of the second part their certain deed of trust bearing date the first day of may A D to secure the payment of thirty four hundred dollars and interest thereon according to the tenor and effect of a certain principal note and interest coupons thereto attached which ara more particularly described in eaid deed of trust said note being payable on the first day ot may A D 1895 which eaid deed of trust was recorded in the office of utah county utah in volume no 8 of mortgages etc at pages to incle 1 bi ve of ane records or said domce abil eiven upon the following described premieres premi ees to wit the south halt of lot two 2 in block twenty 20 plat A pleasant grove city survey area one haaf and 2160 2 of an acre situate in the county of utah and territory of utah together with any and all water rights owned by baid parties of the first bartor either of them or belonging with or used upon said orem isea or any pan thereof and Whore aa it ia provided in said deed of among other things that in case be made in the payment of said indebtedness or any part thereof with interest thereon as specified in said principal note and the interest attached or for non payment of taxes or neglect to renew then and in such case on the application of the legal holder of said note it shall be lawful for said party of the second part after having advertised such sale for twenty days in a newspaper published in eaid county of utah to sell said premises together with all the right aud equity of redemption of the said party of the first part their heirs executors administrators and assigns therein at public auction at the aroni door of the court bouse in the said county ot utah and whereas the fhaid party of the first part and each of them have maje de fauer in the payment of the interest on said principal note due on the first days of may and nov 1893 and 1894 and whereas it is provided in eaid deed of trust that in case of bach default the whole of said principal bum secured by said deed of trust and thereon to the time of sale shall at the option of the holder of eaid indebted f cess or the trustee therein named at once bacome immediately due and able and the eid premises may bei eold in like manner and to the same effect said indebtedness had i fulla matured by lapse of time in said obligations mentioned and whereas the legal holder of said in has declared the whole of said indebtedness to be now absolutely due and payable and requested said trustee to advertise and bell said premises pursuant to the power and authority in him vested in and by said ded of trust now therefore public notice is herenyi given that I 1 james H baon trustee as will on WEDNESDAY THE DAT OF 1895 at ten a m of said day at the north front door of the county court house of said utah county in chiy in said utah counte utah sell at public auction tn the highest and best bidder for cash said premises hereinbefore described together with all the right title benefit and equity of redemption of the said benjamin W driggs and ulivia P heirs executors orators and assigns therein forever for the purpose of mayine gaid indebted ness and the interest thereon and the costs attorneys fees and expenses of executing this trust and will make execute and deliver to tho purchaser or purchasers at ed sale good and sum chent deed er deeds of conveyance in fee for the premises sold dated this day of february A D 1895 a hadaa trustee as aforesaid J W JODD attorney |
