| Show teachers jurisdiction the territorial school law says that aboard of education shall have power and authority r to adopt by lawa and rules for proceed ura of the board of education and make and enforce all needful auls arid regulations for the control and management of the public schools of said city based on that authority the board of education of Provo city has adopted rules and regulations for the of the officers teachers and pupils of the public of provo city utah it is H general rule hardly ever questioned that teachers have control of pupils during school hours and we biad the following special rules among the rules above mentioned 17 pupils shall be under the jurist diction of teachers to and frodi school 25 no pupil shall be al owed to tie part bufore uie appointed time of ie iving babool except in case of or nt the request of the parent or guardian or from some pre ol 01 which the teacher shalle the jue 28 pupils fiust leave the school premises and go directly home after is doali at noon and at night otherwise permitted by the principal etc these rulea clearly give the teachers jurisdiction off the t chool grounds and though the rules have been ruled on in the courts of utah baill rulings in other stats stat s in similar cages land us to believe the rules are rood law there ia at leaah one parent in provo and there may be more who questions the jurisdiction of teachers off the school grorud our view of the matter is that the jurisdiction of the teachers over the pupils to and from dohoo as granted by eule 17 before quoted can be established as legal in the courts if necessary even if punishment b required off the school ground to enforce that rule we believe it is the teachers legal prerogative we are informed by teacher bodinson Bo binson however that he has naver punished parley lawhorn choso whoso case has come before the off the school grounds the teacher did forcibly put the lad in a baggy and bring him back to school during school hours in doing which the teacher was acting within the rules governing the schools the boys father acting probably on misinformation that the boy was abused went to the school and took the lad home again school officers who wore present during the occurrence were about to the surrender of the pupil during school hours had they refused to surrender the lad they would have violated anle 25 which says no pupil shall be allowed to depart before the appoint od time for leaving school except at the request of the parent or guardian under education the school authorities might have legally refused to surrender the lad under the present rules and present school law the parents jurisdiction in tha matter is unquestionably supreme the case is merely referred to for and to discuss the authority of our te achenb the most valuable lesson to be drawn from it is that showing the importance of a cooperation on the part of the parents and the teachers in school management the public schools extend in government to all bomea hat are patrons of the sc hooli harmony should exist throughout it isie grat lable that any coi should ever anso and teachers it is quite aa necessary that harmony ex st between them in school management as that perfect harmony should exist between parents in the government of their children m the family circle |
