Show NOTICE OF TRUSTEES BALE whereas benj amin W driggs and olivia P driggs hia wife aa barty of the first pan executed and delivered to jamea H bacon trustee as party of the second part their certain deed of trust beanum date the first dav of may A D to secure the payment of thirty faur hundred dollars and interest atterson tt erson according to tha tenor and effect of a certain principal note and interest coupons thereto attached which are more particularly described in eaid deed of trust said principal note being payable on the first day ot abay A D 1895 which said deed of trust was recorded in the recorders office of utah county utah in volume no 8 of mort bagos etc at pages to inclusive of the records ot said office and given upon the following described premises to wit the south half of lot two 2 in block twenty 20 plat A pleasant grove city survey area on and 2 of an acre situate in the county 0 utah and territory of utah together with any and all water rights owned by said parties of the first part or either of them or belonging with or used upon said premises or any part thereof and whereas it is provided in said deed of trust among other bat in case be made in the payment of eaid indebtedness or any part thereof with interest thereon as specified in eaid principal note and the interest coupon thereto attached or for non payment of taxes or neglect to renew ns urance then and in such case on the application of the becal holder of said note it shall be lawful for said party of the second part after having advertised such sale for twenty days in a newspaper published in said county of utah to sell said premises together with all the right and equity of redemption of the said party of the first part their heirs executors administrators and assigns therein at auction at the from door of the court house in the said county of utah and whereas the said party of the first part and each of them have made de fault in the payment of the interest on said principal note due on the first days of may and nov 1893 and 1894 and whereas it is provided in eaid deed in case of such default the whole of said principal aum secured by said deed of trust and the interest thereon to the time of sale shall at the option of the holder of taid indebted ness or the trustee therein named at once bacome immediately dua and payable and the eaid prem iaea may be sold in like manner and to the barns effect aa said indebtedness had fulla matured by lapse of time in said mentioned and whereas the legal bolder of said iu has declared the whole of ead indebtedness indebted nesa to be now absolutely due and day able and requested sad trustee to adverties advert iee and sell said premises pursuant to the power and authority in him vested in and by said deed of trust now therefore public notice ia hereby givan that I 1 james H bacon arna tea aa aforesaid will on MONDAY DAY OF 1895 at ten a m of said day at the north front door ol 01 the county court house ot said utah coun tv in provo city fa edict utah counte utah sell at public auction to the biebert and beat for cash aard prem iaea hereinbefore described together with all the right benefit and equity of redemption of the asid benjamin W drieda and olivia P beira executors administrators and therein forever for the purpose of mayine said indebted feea and the interest thereon and the costs attorneys fees and expenses at this and will make execute and deliver to the purchaser or purchasers at said sale good and soffi or deeds of conveyance in fee for the premises sold dated this day of february A D 1895 JAMES H bacan trustee as aforesaid J W juno attorney |
