OCR Text | Show TRUSTEES SALE whereas D B D houtz and edna L houtz his wife both of the county and territory of utah aid by their certain deed of trust dated september 25 1893 and recorded the same day in book 15 of mortgages page in the boffl office e of the recorder of utah counte utah ter convey to the undersigned undersigner under signed as trustee the following described real estate situate in utah county utah territory to wit commencing Com at the northeast corner ot block 44 plat B provo city sur aur vey of building lots lota running thence west twelve 12 rods roda thence south six 6 rods thence esst eest twelve 12 rods thence north six 6 to place of be beginning inning in trust however to secure the pay ment of their certain promissory n te ti therein lerein described in the sum of three thousand dollars payable to the order of joseph D jones the of the third part in said deed of trust with in terest thereon at the rate of fifteen per cent per annum from the date data thereof pay payable ablia quarterly and w whereas said deed of trust provides that in case default be made inice in the payment of said note or any part I 1 thereof hereof or of any interest thit thi t may accrue thereon then said deed shall remain in force and the said party of the feconda part may proceed to beell eaid described property or any part thereof at public to the highest bidder for cash either of the parties to said deed aced being at liberty to become the purchaser at such sale eale at the front door of the county court bouse in provo cita utah first giving twenty days davs public notice of the time terms and olace of said sale and the property to be sold bv adver ti in some newspaper printed in the english lan language image and Dub listed in said provo city and upon such sal sale le the said varty party of the second part shall execute aad deliver a deed deba or deeds in fee simple of the property alli to the purchaser or purchasers thereof and out of the proceeds of eaul ea d pale ale airet pay the expenses of said trust including reasonable ati orney and bursel cur sel tees and compensation to said eaid trustee for bis services second pay the amount pa gaii 1 l by the said party of the third part for taxes insurance or mechanics liens liena uder the covenants in said deed dead of trust contained with fifteen per c ent cent per annum interest thereon from the and on november 10 1894 paid tax claims amounting to which claims being against oaid ead real estate it was necessary for him bim to pay for the protection of the lien of the said deed of trust and by the terms ot which deed ho is entitled to a lien the said zeal real estate and of df which iL amounts mounts no part has been repaid by the parties ot t the first farat part and whereas the said D D houtz and edna L holitz on july 9 1892 e exe buted and delivered tn one A H raleigh x a mortgage on the above described real estate to secure a noie in the sum of 1250 00 with interest at the rate of one per cent per month payable anar quarterly which mortgage remains uncut isfried and is a lien on the real estate described in said deed of trust and prior thereto and whereas joseph D jones the hold of said eaid note has requested the under signed trustee itee to sell said real estate ac cording to the terms and conditions in said deed of trust contained now therefore public notice is hereby
