Show in contempt judge bartch of tile alie third district court yesterday jester Yester dav rendered a decision in the george 0 whitmore Whit moie wole c aee one of the principal princ questions of the eme casa remarked hij bonior was wag as to the jurisdiction of the court it having been bean transferred by tie me judge of jb abo first district on his hia own motion which defendants counsel claimed to he be an i illegal proceeding after the transfer once enca the matter by common consent was referred to a referee the referee tried and determined it and his report was confirmed by this court thon than arose the question as to the all sufficiency of the transfer his honor took it that the court having juriE jurisdiction diction bad a arif right ht to transfer ani and that that transfer was a judgment of the court the court had a right to inquire into the transfer especially when the parties did not raise any objection thereto if they had bad desired to do so eo they should have objected before this time there was some question as to the order or decree of this court not being person er 1 ally served upon tho d defendant 0 fon but having been in court he must have known of it and his honor thought under those circumstances the court must now adjudge him guilty of the contempt alleged on this trial the witness oo showed considerable feel feeling anz on both sides there seemed to bo some difficulty between these parties but on the main facts in the case so far as aa they appeared belore before him ho he did not cot wish to express an op opinion laiGn the do de fondant had no right to take the law lair into his own ba haada ids and destroy the boxes placed by order of the court if he had been dissatisfied with the decree he ha should have sought bought tiie tae proper legal he ha wea was disposed however to be somewhat lenient on certain conditions and would postpone sentence for a period of ten days jf if in the meantime the defendant restored the box in accordance with the decree and replaced it in the same condition in which he found it the court would take that into consideration in fixing the punishment puni ah A bill of exceptions was filed and a notice of appeal was given |
