Show FIRST DISTRICT COURT the pr provo ovo city llumbet co suit before blackburn FRIDAY A session of ortho the first district court i wart held this morning inor ning judie jude blacken the bench the cibe case c ibe of william H king at al stockholders L ock holders and creditors of the provo city lumber GJ co ism TB M L todd etal stockholders of the pro prove vi city lumber co recognized and ane assignee was bro brought u h t up thurman sutherland sui h e r land represented the plaintiff and elmer B jones jonea and F W woods the defendant the plaintiffs plain tifft presented an amended complaint charging the defendants with intent to defraud plaint plaintiff iffa ii and a king for relief as aa fully set forth in a recent issue of tux THE E at the time of the filing of the original complaint the amendment EO 10 the complaint plaint brings in in several new creditors and aad makes otha minor changes in the complaint the defense demurred to the amended complaint on the ground that the suit 1 have been brought by the cor corporation pora tinn the provo city lumber company in behalf of the stock stockholders hollers and not by the rs of the corporation po ration the creditors it was wa admitted had a right to bring b ring suit I 1 act t their connection with the tha stockholders was a in 1 sio inder the demurrer was overruled the court however expressing a doubt as to the legality of the joining of the th stockholders and the creditors in the ou ait it as their interests were not identical the defendants defend anta asked that the res ren training order be dissolved the court tadd stated thit the restraining order was temporary and would be dissolved as soon as aa the came as heard without any order the defendants were not prepared p red to answer the amended complaint and the tha case was continued until dec the restraining order continuing without any an y further order being made |
