| Show no ko superintendent to be elected attorney 0 S varna has hag written the following letter which is ia belf ex es plan pl antory tary OFFICE OF TIN I 1 TIED STATES Ls ATTORNEY Y ST SALT LAEB CITY OCT 28 IS hon I 1 elijah sells secretary city sim SIK I 1 am in receipt of your common requesting my opinion in the matter of electing co county anty r superintendent 0 of schools ech viz whether under existing laws such officers are ara to be elected at the tha ensuing election by act approved march 10 1892 it Is ia provided that a general election shall be held 0 the first tuesday after the first montay monday in november of 0 the present year jear and bien biennially thereafter for the election of territorial T I 1 county and precinct officers by act approved the same day and entitled an act to provide for the uniform system of free schools thought thou glit 0 out ut the territory ll 11 it ja 3 enacted that at the general election for the year 1893 and biennially blennia lly thereafter there the re he be elected count county Y ants of schools for each C county t and a subsequent section in the tb on acme L 8 act provides pro yides as follows and the term of office of all county superintendents now in office are hereby hareb y continued until the expiration of th the full terms of office for which they were elected have expired by act approved march 13 SOO 1800 it is provided that a county superintendent of schools shall bs be elected at the election for the year 1891 and biennially thereafter and that his bis term of office shall be two years yeara and until his successor sir is ia elected and qualified in the light of these provisions of the several statutes bearing upon the subject su there seems to be no room for doubt that this office is ia not to to be filled fil led at the coming election at least that is mv my opinion very respectfully G C S B S attorney I 1 |
