committee on fire department to whom waa referred the communication of the inspector in relation to a certain building being erected by Itaw lings gray within the fire limits respectfully report that we have considered the same and find that said building does not comply strictly with the provisions of the ordinance regulating ahe construction of buildings within the fire limits and from our information believe that the parties were misled and they believed that they were constructing a building that would requirements of the ordinance from the fact that other buildings constructed in the same manner and of the same material viz a covering of sheet iron over a frame work of wood had been allowed in several instances within the fire limits which would be misleading to parties not familiar with the ordinance this condition of things we believe has grown out of the inspectors not enforcing the ordinance di nance believing no doubt to do so would werk a hardship in many cases and would have a tendency to retard legitimate enterprise believing also that time would remedy nany of the existing difficulties be permitted that which should not have been permitted if the strict letter of the law had been followed taking the situation as we find it we respectfully recommend that all buildings that have been permitted to be built since the passage of the fire ordinance and in violation of the same in certain respects including the b bild ing of gray be permitted to remain during the pleasure of the council but that no building hereafter erected that does not conform with the ordinance be allowed to remain we believe our city has arrived at that stage when nothing but good substantial buildings filling every requirement of the ordinance should be permitted to be constructed within the fire limits we also recommend that trie ordinance be mended am so as 10 make it the duty of parties contemplating building 10 submit their plans to the inspector for bis approval HJ maiben chairman councilor dixon did not re port Itaw lings been notified that their building was not in conformity vilh elih requirements of the ordinance before they had gune to much penrod bidock as quick as lightning councilor was not in favor of this class 02 buildings but he thought the ordinance was somewhat defective and should be amended parties erecting buildings within the fire limits should be compelled to submit the plans of their buildings to the inspector before commencing work the city attorney had expressed his opinion that if the council compelled rawlings
