his report lor april showing number of arrests 37 fines assessed by city justice paid in canalle canal ll paid in labor days on appeal in district court 70 deport accepted A A noon justice of the peace presented his report for the quarter endine april 30 showing number of cases heard cash paid in city treasury days of imprisonment COMMITTEE the committee on judiciary mr maiben chairman reported a bill amending the ordinance ia relation to awnings as petitioned far by merchants of the city report accepted and bill filled for first reading the committee on railroad rail roal and telegraph chairman becom mended that ane petition of the rio grande western railway co asking for the privilege of maintaining three tracks on first street between J and M streets bo granted during the aure of the council several of the members expressed their dissatisfaction with the report as the street would be almost completely blockaded especially so if the U N C ky co should construct their tracks the union pacific also biad rights on the street it was also understood that the kio grande western people would object to the clause during the pleasure of the council deemed advisable by alie committee to make the recommendation in order that be ascertained what would be acceptable to the railroad company and adjoining property owners the report was rejected mr henrichsen chairman airman co af the committee on finance ing that the salaries of city officers be reduced to the following rates recorder per annum police officers 60 per month road supervisor per day and his deputy 2 wat ermas ter and deputies 2 mr henrichsen Henric haen explained that the committee bad not will mely made reductions but the financial condition of the city made it a matter of feces acty mr dixon was rather in favor of reducing the electric light etc alian reducing the officers salaries mr maiben one of the committee had reserved the right of opposing certain clauses of the report he was especially ally any reduction of the salaries of the officers the sal aries of the other officers wera also low enough without any further reduction he would prefer to see the city disposed ot and if satisfactory arrangements could be made the number of electric eler lights reduced mr glazier a member of the committee seconded the position taken by mr henrichsen it was not a desirable job to cut down the salaries but something ha 1 to be done mr henr achsen like the way mr maiben had he had not known that the gentleman pent leman from the fourth ward intended opposing the report until 8 in the evening why had he said nothing about the city nurse in committee meeting it could ba done he was in favor of cutting out all of the electric lights if necessary during the summer months mr dixon gaye figures that the salaries of our police officers and also of other officers were very smaller than those of salt lake he thought a police officer in provo city bad equally as much to do as a salt lake officer marshal brown stated that he would rather get along with three officers than to have the salaries reduced mayor booth stated that the city was now where he foresaw it would ba lie then gaye some figures showing how expenses had gradually increased he had succeeded iu borrowing money as he had been authorized to do but he had bean compelled to pay a higher rate of interest it would consideration the committee on judiciary judic jary reported as follows to the city council of provo city GENTLEMEN your committee on judiciary to whom wae referred taft petition of R ausy bennett aad others liquor entail dealers of grovu city baving duly considered the samp respectfully submit the following in the opinion of your committee alie peti have ni grounds for g the liquor ordinance is fair and imposes no oppressive oppre saive burdens upon the vendors of intoxicating liquors to control the liquor traffic and to carry into effect reasonable and proper is one cuties devolving dev olvine upon the municipal body heretofore the city council in response to the of some of the persons who eigi iho fraid petition amended alie ordina nii regulations regul atins the vending of intoxicating liquors and the said council your committee believes has ever been willing to see that persons engaged in th sale of intoxicating liquors under the ordinance were fully protected and their rights considering Consid eing the alleged grievances in their order we have to say fer aa we can learn there are but few if any gales made bv persons without a licence and we believe the have used duo diligence dili tence to prevent any infractions of the aforesaid ordinances SECOND upon investigation your committee is of the opinion that police officer of the city have not invaded the saloons of the petitioners petition ers nor have they intimidated the customers thereof the rahce officers have gone into the saloons for the purpose of seeing that the ordinances 0 the city were respected but so far as your committee is alvi aed they have done no more than their duty and their presence has acted as a preventative of crime THIRD under the ordinance the saloons are required to close at 12 midnight and in the opinion of your committee the request that the saloons be permitted to keep open all night should not be granted it is questionable whether the city council has the authority to make it an luense for which minors could be punished for minors to visit afons a alie present ordinance provides that aay person licensed to vend intoxicating liquors who shall permit any minor apprentice or employee under the age ot 21 years to remain in bis place of business where liquors are sold without the consent of parents guardian or employer thereof shall be deemed guilty of an offense this legislation your committee believes to be wholesome to punish the minors and not the persons whose business ures them there would not tend to preserve the morals of the FIFTH the attitude of taft city in regard to persons not regularly licensed to retail liquors cannot be mistaken the ordinance itself provides that no person shall manufacture bell barter deal out or otherwise dispose of intoxicating liquors without obtaining a license it is clear that this provision reaches physicians and druggists and prohibits them from bending liquors without procuring a license in accordance with this view the city attorney had prosecuted a physician who lad disposed of liquor without shaving obtained a license it ia worthy of note that the attorney for the petition ers upon the hearing of said case took the ground that the city council could not prohibit and that the ordinance did not apply to a physician who might sell intoxicating liquors for medicinal purposes SIXTH your committee believes that the city council has not under the guice of wholesale licenses infringed upon any rights which the petitioners petition ers possess twelve hundred dollars per annum for a retail liquor vendor is not nor unfair when compared with the license required at the hands of wholesale dealers there are no persons licensed to sell liquors as wholesale dealers who pay less than six hundred bollara per annu m your committee believes that the nature of the business prosecuted by each of the else es above named warrants the difference in the license exacted of each class lastly your committee has no objection to the organization of the pe titio ners into an association or union but it further believes be lioves that said petition ers have had no rights infringed nor have they made any demands which are justified and consequently any which the city is compelled to accede to A libera ordinance has been passed and under it the rights of the petitioners petition ers are fully protected it is tue duty ot ane to execute the provisions of this ardi nance as well as the provisions of all others and so far as your committal commit tae can learn the benders venders of
