Show OF TAXES the legislative enactment prof tiding boril SECTION 1 be it enacted by ahe governor and legislative assembly of the territory of utah blat a territorial board of equalization of assessment of territorial and territorial school taxes is hereby created for the years 1888 and 1889 SEC 2 said board of equalization shall consist of seven persons all of whom shall be elected by the joint vote of the present legislative assembly provided that not more than one member shall be elected from any comity except salt lake county which shall be entitled to two members each member df said board i shall take and subscribe the oath of office which shall be filed with the auditor of public accounts SEC 3 said board of equalization shall meet at the office of the territorial auditor of public accounts in salt lake city at 12 noon on the third monday in june of each year and a majority of said board shall constitute a quorum to do business at the first meeting of said board a chairman and a secretary shall bo appointed from among their number SEC 4 the county cleric of each county in this territory shall on or before the third monday in juno of each year prepare and forward to the auditor of public accounts for the use of the board of equalization a copy of a sufficient number of pages from the county assessment roll of his county to show at least two pages of the assessment of property in each precinct of his county said board of equalization is authorized zed to call upon the county clerk of any county for a copy of any further portion of the assessment roll of such county whenever they may deem it necessary and the county clerk so requested shall immediately prepare a copy of the pages of said assessment roll designated by said board to which shall be attached his certificate of the correctness of said copy and transmit the same to said board said board in the performance of its duty may visit any part of the territory and shall also have power to administer oaths by its chairman or secretory to sum morito its aid the assessor of any county or any other person and also him or them under oath and also examine said copies of tho assessment roll in order to ascertain the actual and assessed value of taxable property both real and personal comparing one county with another SEC 5 said board shall make changes in tho assessed valuation of the different classes of property in any cormay by increasing or decreasing tho same such per cent as may be necessary to equalize the assessment of such county with the assessment of other counties provided that the county court of any county in which it is proposed to increase the assessed valuation shall have not less than ten days notice to appear by representative and resist such increase inci ease SEC 6 the action of said board of equalization on the assessed valuation of the property in any county of this territory for the said years 1888 and 1889 shall be final the said board shall finish its labors and file a full and complete report of all the changes made by it with the auditor of public accounts on or before the first day of august of each vear and immediately thereafter th secretary thereof shall giva notice to the county court of each county of the action of said board affecting such county SEC 7 on receipt of said notice of the action of the board of equalization iza tion each county court shall cause said notice to be entered upon aig re cords and if changes have been made by said board the county clerk shall thereupon enter such changes upon the assess roll by adding to or taking from the assessed valuation of the different classes of property in the county yach per cent as such notice shall designate and give notice by publication in some newspaper having general circulation in the county and by causing a notice of such change to be posted in at least three public places in each of said county SEC 8 the said board of equalization shall furnish to the tive assembly of the territory within tha first two weeks of its session a report of its official proceedings under this act with such recommendations as it may deem proper SEC 9 each member of said board shall receive for his services while actually engaged in the work of equalization 5 per day and per mile coneway only and each person summoned as witness or aid shall 3 per day and the same mileage allowed to members of the beard SEC 10 the territorial auditor of public accounts shall aadil the ad counts of sald board of equalization for per diem and mileages and draw his ints for the amount due which paid out of the chem tonal and the or so much cherof as may be necessary is appropriated for the payment of such S 1 ie CT s f 1 a 0 f A |
