Show Gisborn Case Decided. Judge Hall gavn gavo an interlocutory decrco yesterday hi tho case of Gisborn t r vs. the Utah Commercial nnd Savings bank. This case was brought to secure possession of a deed to somo mining claims, Tho deed had been placed In escrow with J E Calnc. cashier of the bank. Tho claims aro located In Tooele county. The deed was to be handed to a third party In case certain sums of money wero paid. The money was not paid and Gisborn sued to recover the deed. Tho decree provides that the defendant shall havo time to examine tho records of Tooelo county. If tho title to the claims Is found to be still perfect, tho sum of SH.000 shall be paid to the plaintiff. Tho deed can then be handed over to the third parly. Court Notes. Decree for the plaintiff was granted by Judge Hall yesterday in the case of Florence Brastow vs George Brastow. The plaintiff was suing to prevent her husband from disposing of his share In a legacy. The plaintiff and tho defendant defend-ant are separated. She claims a share In his share of tho legacy. She thought he was going to dispose of It. The court has forbidden him to do so. J. W. Houston hus brought action In the District court, as executor of the estate es-tate of Alfred Thompson, deceased against S. Hays and M. O. Hays. He wishes to have a certain deed executed by Thompson to Hays declared a mortgage. mort-gage. Ho asks this on tho ground that it was executed as security for a lean made by Hays to Thompson. A. H. Beach, who was charged at Murray Mur-ray with getting money under false pretenses, pre-tenses, was released yesterJay and exonerated. ex-onerated. Beach was accused of getting a worthless check cashed at Oalloehcr .fc Frlcl's saloon nt Murray. It was thought that he had wilfully misrepresented that he had money In tho bank to meet the check. The money was paid to Galla-cher Galla-cher & Frlel. Beach was released without with-out any charge ngalnst him. His accuser said that it was a mistake and that Beach Is Innocent. Judge Dlehl yesterday morning bound tho man over, placing tho bonds at $IG00. An effort will be made Monday to get theso reduced. Alvaro A. Pratt, a contractor of this city, yesterday filed an application to bo adjudged bankrupt. He has no proporty and no money, and his debts amount to JHa2.4o, of which 51175 Is secured by mort-gago mort-gago and J32u.-I5 without security. Bills of merchandise owing to local merchants run in the thousands of dollars, and loans of money, unreturned, havo been made to tho applicant by many persons both in and outside of Utah. In his application ho states that he is a descendant of Alma Pratt, deceased, whoso estate Ks at present pres-ent being contested In court, but that on account of payment not having been mado in full on said estate by Alma Pratt, ho considers his share In tho estate worthless. |
