Show TilE CASE AF CRIPPLE CREEK Senator Patterson < and ExGovernor Thomas of Colorado give sound advice in regard to the situation at Cripple Creek They hold that the civil law is supreme military law not having been declared and that the writ of habeas corpus must be respected < together with all necessary orders In connection therewith there-with At the same time if the military resist by force a greater evil than the failure of the writ or of the orders of the court In connection with It would be liable lo ensue if the Sheriff should call out the posse comiuitus and attempt at-tempt to enforce the court process They are evidently of the opinion that whatever what-ever of Irregularity may now be suffered suf-fered can safely be left to the cure of time The situation created In ctvse oC the refusal of the military to yield Is anomalous military law not having been declared But on the other hand If I the court can step in on such an occasion and thwart Ihe very purpose for which the military Is called out there the Governor Gov-ernor has no power to enforce order or protect property against organized resistance re-sistance It would probably have been hotter to declare martial law at once in the sphere of the operations of the military mili-tary force for without this such questions ques-tions as have arisen und other questions ques-tions t designed for the same end may very seriously hamper the efficacy of i the military arm or break l Its strength utterly A divided authority is i fatal lo the rIght accomplishment of tiny purpose pur-pose where there are opposing sentiments senti-ments and contradictory activities |
