Searching Cross Examination The major portion of the day in the Payne murder trial yesterday was devoted de-voted to the examination of County Physician Mayo The witness was called to the stand by the State about 3030 in the morning and remained under un-der examination until noon when court look a recess until 2 oclock When adjournment was taken at 5 oclock until this morning Dr Mayo was sllll being subjected to a riGId crossexam i Inatlon by TV F TVanlcss the defendants defend-ants attorney CAUSE OF DEATH The expert testimony of Dr SIdyo 7 who was one oC the physicians who performed per-formed the autopsy on Miss Anna D IIIII was strong for the Prosecution find little shaken by the defense In I his judgment Miss Hill died of paralysis I pa-ralysis of the pneumogastr nerve I which wns Induced by the admlnlstia tlon of chloroform Attorney Wanlcss has evidently been reading up on medicine medi-cine and surgery and he was able to I handle with comparative ease some of the Jargest and longest technical oids known to these sciences but Dr Mayo was a match for him In that respect mid pronounced several that N r Wan less had never heard before NOT RULED OUT The oilier witnesses examined yesterday yes-terday before Dr Mayo was called were William H Trcmaync and Detective De-tective George Chase Mr Tremayne who has an assay office in the same building where Dr Payne has his of lice testified that he was In his office nil day but that he had not seen Dr Payne until in the afternoon after the police ofllcers an Ivcd when he first learned of the death of Miss h ilL The 4 1 motion of Attorney Wanless that the evidence be stricken out on the ground that it was Immaterial was denied by the court courtWHAT WHAT CHASE KNEW S Detective Chase was recalled yesterday yester-day morning to Identify a short coat mid a black fur boa as the ones that I he had seen In the office of Dr Payne when he entered the room on the day of her death ITo said they were the same and turned them over to Mrs McKayDR DR MATO A WITNESS The witness of the day was then + asked to Lake the oath by District Attorney At-torney Elchnor Dr Mayo testified that he had first seen Miss Hills body In the office of Dr Payne about 3 oclock in the afternoon on December 20th last About an hour later on the same day he made n partial examination of her body at the undertaking parlors and 5 discovered bloody cloth her 5 upon person i per-son The cloth was identified by the witness and he further stated that it had not been fastened to the womans clothing That fame evening the autopsy was performed by Dr Mayo his assistant and the County Attorney AH of the organs of the deceased were found to be In normal condition wIth f thc exception of the heart which was smaller than natural and the lungs and kidneys were congested l DAMAGING TESTIMONY In his Judgment he said the rupture of the embryonic sac must have occurred I oc-curred within two hours of the time of her death and that the rupture must have been made with some Instrument that could have been opened to dilate the cervical canal 3Te examined the Instruments that were found in Dr Panics office and said that any of them could have been used for that purpose He did not think that the oung woman could have performed the operation herself and gave his reasons rea-sons for < nttrtalnlng that opinion He I was positive that no operation was necessary ne-cessary to save Miss Hills life or that It was demanded by her health Any great shock to the heart such as the pain of the operation he said might cause paralysis of the pncumogaslrlc nerve The witness also said that IL was a dangerous operation to administer I adminis-ter chloroform to a patient in an Ill ventilated room for the reason that there would he insufficient oxygen to meet the requirements of the system I NATURE OF THE PILLS In regard to the pills found in Miss IIIlls room after her death he said that they were usually taken for abortive abor-tive effects but that they contained an Insufficient quantity of oil of iRvine to product the desired result The pills fire called Emmenagogue No 1 and contain 1 grain each of ergotin bon Jean extract cottonroot bark and purified aloes and lji grain each oC oil of savlnc and extract of savlne As far ns producing a fatal effect he said that twenty of them could be taken at a dote and not have a fatal result FIRM IN HIS BELIEF On crossexamination Dr Mayo testified tes-tified to the fact of Miss Hills having been alive when the entered the office of Dr Payne and that she was dead when he saw her which led him to believe be-lieve that she had died from paralysis of the pneumogastrlc nerve and that the paralysis had been caused by the administration of chloroform MEDICAL ETHICS Attorney Wanlcss Inadvertently made an opening for the District Attorney to attack the reputation of Dr Payne when he insinuated that there was a prejudice on the part of the witness against the defendant and asked him 1C it were not true that he had said that he would yet fix him Dr Mayo said that he had had an opinion In regard to the reputation of Dr Payne for more than two years but that he had not at the present time nor ever had any prejudice against him The fact that Dr Payne had been Implicated on several sev-eral previous occasions In cases of simIlar sim-Ilar nature was also drawn out of the witness He said that only in one casein case-In which he had been connected had Dr Payne been placed under arrest What case was that asked the attorney It was that of Annie Taylor QUESTION OF RATIO The proportion of death In the administration ad-ministration of chloroform he said was about 1 in 10000 In early days It was about 1 in 20000 Miss Hill it was staled might have performed such an operation had she known how but In his Judgment she could not have torn the embryonic sac as it was torn He also said that In his Judgment based upon his examination of the womans organs she had not taken sufficient of the pills to cause her pain There were but few spectators in the courtroom yesterday |
