Show MUST EEL ON COURTS Interesting Ruling Handed Down From the General Land Office A ruling Just received at the local offices of the register and receiver from the Commissioner of the general land olllce at Washington advises Steve Hayes who is seeking a patent on the Agee mining claim at Blngham and to that end attacking the entries made on the Lamson Allan and Helene Hel-ene entries that the Issues are solely within tho province of the court In Utah to determine The office at WashIngton Wash-ington says the Commissioner must therefore decline to take any action In the premises at this time The Lamson Allan and Helene mineral min-eral entries in Bingham near the pos ej ° lons of the United States Mining company have been subjects of litigation litiga-tion In the I local land office in the local courts ana In the general land ofllce at Washington for some limo Mineral entries according to the record were made and receivers receipts Issued In 1S98 and subsequently held for cancellation cancel-lation It being erroneously I assumed by the Washington office that they come under the Copper Glance decision deci-sion At later day December 1901 the entries In question were reinstated In the meantime Hayes el al had model a mineral application for patent on the Agce claim covering a portion of the same territory The Commissioner of the general land olllce under date of July C 1003 has denied the petition to set aside the mineral entries comprehending compre-hending the Lamson and others and now relegates to the local courts the settlement of Hayess rights As the applications for patent on the Lamaon Allan and Helene claims wora not advertised ad-vertised during the period of publication publica-tion it Is contended that It Is now too late to do so The ground covered by these entries Is traversed it Is I said by a portion of tho great Brooklyn ledge for which the Dalton Lark tunnel la now headed and by the claimants Is esteemed as quite valuable |
