Show V FARMERS WIN WATER CASES Irrigation Suits Against Receiver of Bear River Irrigation and Ogden Waterworks Company Decided S S I j Judge Marshall of the Federal court rendered a decree In the cases of John Spiers ot al vs William C Weaver as receiver of the Bear River Irrigation Irriga-tion and Ogden Waterworks company by which the plaintiffs are given judgment judg-ment amounting In the aggregate to Sj6ISl2The chief significance of the decree however Is V that It forms a precedent likely to be availed of by other people against the canal company com-pany The plaintiffs sued to recover damages alleged to have been done their crops through the diversion of water from the Ogden river through the Bear river canal to the Ogden waterworks system during the irrigating Irrigat-ing acason of 1900 The plaintiffs all held water rights from tho Plain City Irrigation company and it was claimed that the damage arose through a shortage of water for Irrigation pur poses through the Bear River company taking watfcr out of the river aboVe the point where the Plain City ditch has Ito Intake Judge Marshall in the decree holds that It IK I clear the Plain City ditch was constructed In 1853 and took water from the river In 1SC3 It Is also evident he holds that the Plain City ditch Incorporated as early as 1870 and that the plaintiffs owned water rights at the lime when the damage Is I alleged to have occurred He does not estimate the total damage dono to the crops through the water shortage as he says this Is Impossible Impossi-ble when It ly I remembered that the fruit In that section was affected by l San JOSQ scale during the season named There were four plaintiffs but the suits were consolidated for purposes pur-poses of trial the allegations being the same In all cases John Spiers Is given judgment for S1110JO William ling land ror 3010I7 James Hunt for JIM 106 and William Skecn for 105399 |
