HOWARD IS RELEASED Charge of Fleecing J M Richmond 1 is Dismissed Frankh Howard who was charged with vagrancy and gambling was discharged dis-charged by Judge Tlmmony yesterday Howard had been arrested on the complaint com-plaint of J M Richmond alias Henry Fairchild who charged that Howard had lured him Into a roominghouse under the pretense of showing him some mining pioperty had Inveigled i him Into a game of cards and then ileeecd him out of about 55 Richmond Rich-mond was on his way to California and Jn order that he might proceed on his journey his testimony was taken on Saturday last It was to the effect that he had engaged in a game of cards with Howard and others and had lost Attorney Lippman objected to the manner In which tho testimony had been taken and proceeded to show what rights the defendant had under the statutes The Judge listened patiently If thpre is no more testimony to be Offered than that given on Saturday remarked the Judge the defendant will be discharged I have no more your Honor remarked re-marked Dlehl Then Howard may go Jlojvard his attorney and a friend who hind been unremitting in his attentions at-tentions to him at once loft the courtroom court-room That Richmond had lost money at the game said the Judge he had no doubt but under the circumstances he did not see how any distinction could be made All were guilty or none were guilty All had gambled which was an infraction pf the law
