S. statutes, 17 ). It results thai so far as this congressional restriction js concerned, each has the. power, under proper territorial legislative authority, to incur indebtedness to the amount in the aggregate (including existing indebtedness i not exceeding 4 per reetof'the Talue of the taxable properly within each of said corporations, to be in the ciannerprovided in tho con. gressional enactment. This conclusion alo results in answering the second question in the sffirmative, so tar as the congressional restriction is concerned. It also results in answennif the third question in the affirma-tive, so far as relates to the congressional restriction. It is perhaps not necessary to enter into any extended argument in support of the valadity of the above conclusions. It is my opinion that Salt Lake City is a "municipal corporation" w ithin the meaning of the con-gressional act. Tho charge of schools Is not one of the ordinary duties of a municipal corporation, like the care of streets, nor dues the legislation of the territory.
