0 of public instruction submitted to tho the attorney general the following question have hav 0 county commissioners it a lawful right to change the salary of county superintendent of schools three months prior to the election in november 1836 1896 after having fixed hla his salary 0 once nee within thirty lays days after the taking effect of chapter of the laws of 14 stig in accordance with section 4 thereof yesterday attorney general bishop replied to the doctor in a written vr Itten opinion in which he holds that any such attempt to le adjust the superintendents salary would be vold void the law provides that the tha salaries of ca county un IV officers shall be fixed by the board within thirty days after t this his act shall take effect this was done in the ewe case in question within the prescribed thirty days another provi provision of the same law says tho the board shall fix the salary galax y at least three months prior to tho the election of 1896 and biennially thereafter under tinder this section the board attempted to again fix the salary of the county superintendent but county superintendents superintendent 9 were riot not st at the lection election in I 1 the law says they shall be elected in july 38 3 8 and biennially thereafter hence it would be tho the proper construction of tho the law that the salary of county superintendents should be fixed at
