Show TO PROTECT PROTE CT OFFICIALS House and Senate Bills Introduced Restricting Prosecution Representative Kuchler and Senator Hollingsworth of Og Ogden en yesterday r in hi introduced In n the house and senate their bills designed to protect public officers from prosecution The bill was drawn to meet such uch cases as the recent prosecution prose prosecution cution of Chief of Police George Georgc A Sheets of Salt SaIt Lake Chief or of Police Browning and several cit city councilmen of Ogden The text of the bill Is as follows Be It enacted b by the legislature of the j i state of Utah I Section 1 That section Revised I Statutes of Utah 1898 1393 be and the thc same is hereby amended to read as follows I 1580 Accusation b by Private Party Parl When Then any accusation in writing verified by the oath ot of an any taxpayer shall be present presented ed to a district court alleging that an officer within the jurisdiction of the tho court shall lute have been guilty of knowingly know wilfully and corruptly charging and collecting illegal fees ro for services r rendered or to b be rendered in fn his office or shan shall have knowingly wilfully and corruptly refused or 01 n to per perform form orm the official pertaining to hIs office the tho court must cite the Party uart charged to appear before the court at ata ata a time not more than ten nor less than five days davs from the time th the accusation was wa pr presented provided that said ae ac accusation be accompanied by a petition signed b by taxpayers of the county in which said action is brought ht verified u upon on their oaths that the a ac action tion is brought In good faith and that thatto to the best of their knowledge and belief he be lief the charges made therein art are true and requesting that said cit be is issued issued sued and on that day or some sub subsequent sequent da day no not morE than days from that on which the accusation was presented mu t proceed to Impanel a jUr jury and hear the accusation and evi evidence dence offered b by the party varty accused ed providing that It if said accusation is pre presented when a setting or of cases under the rules of the court has already been heen had then the said twenty f days shall begin to run from the date on which the thelast last case is set and If on such hear hearing ing It shall appear It the verdict 01 0 the jur jury that the charge Is sustained the court must enter a Judgment that the party part accused be deprived of his office The I and accused shall shaH he requIred to VR pay in advance to the clerk of the county in which the action Is brought the same fees required in civil actions and upon the final deter determination of the action the costs shall hall be taxed as in civil actions |
