my cabinet who have con conferred rend furred with son some members ef of the tutor inter interstate state commerce commission to facilitate thee tM appeals from train the by th t the creation of a B separate interstate com Cent commerce commerce merce court of five members which shall sit in Wa Washington and which shall be bethe b bethe the only court to which petitions to set Sat aside or nullify the orders of the inter interstate InterState state commerce commission can be made and It is proposed to allow a single judge to make an order staying the proceedings of ef the interstate commerce commission n but sixty days and thereafter that no injunction shall be allowed against the order of the commission unless s granted by the whole court of five members A second change in the interstate com corn commerce merce meroe me law ought to give to the commission the power to hear and entertain corn com complaints plaints against unjust classification of merchandise for transportation It is per perfectly perfectly perfectly clear that by including in ludins articles in inthe Inthe Inthe the same dam class which ought to pay dif different different different ferent rates a railroad can commit ex exactly exactly the same kind of injustice as it would wo ld bj by Imposing an exorbitant rate as asto asto asto to any ono oivo class Hence I have not the slightest hesitation m In hi recommending to congress that the power of the commis commission sion slon should be extended to Include not only the fixing of rates rate on a complaint but also the readjustment of classification tion if it proves on cn complaint to be UnJust un unjust just juat New Rate Classification Under the interstate commerce law a anew anew anew new rate classification Is to be filed amendment to the act should provide that the commission may by order suspend modify or annul any changes in the rules or regulations which impose moose undue burdens on shippers No o doubt ought to be left with respect to the power of the commission ion on such a It subject be because becane cause cane eau the rules and regulations of a rail railway railway railway way are the means by bf which injustice may be done to the shipper hIpper It would seem m well to the commission to compel connecting carriers to unite in informing informing forming tonnIng through routes and to fix tb the rate and the apportionment thereof among the tb a carrier 38 The mm ou should also alno be empowered to t prescribe the rules and regulations under which the shippers shall ahall have the privilege to designate the route over which their ship shipments ments monte shall be parried carried to the destination beyond that of the first carrier Another most important amendment of the Interstate commerce law part of ot which was specifically promised in the platform is a prohibition against any in interstate Interstate railroad company acquiring stock In hi tiny any nV competing railroad In the future and a further provision that no nu railroad engaged in interstate commer shall after a certain date hold stuck stock in a corn com petin railroad Agree on Tariff Rates In addition to amendments to the law which are looking lookin to a rather more dras drastic drastic drastic tic regulation of railroad rates than heretofore another provision should be te added by which railroads s may be per permitted permitted permitted to agree agres upon traffic rates and make contracts with respect re to rates that shall shaH not be pooling contracts but shall constitute agreements as to rates pro provided vided always that such agreements shall receive the approval of the Interstate commerce commission This brings brines me to the question of the antitrust law While we have not threshed the whole matter out so as to reach a II definite conclusion lon I am am stilt still inclined to the view that the way to make the antitrust law more effective is to narrow its scope somewhat so 80 that it shall not Include in its prohibition and denunciation as a crime anything but a conspiracy or combination or contract en entered entered entered Into with actual intent Int nt to monopolise monopolise olise or suppress competition in hi Interstate trade trad It has been suggested that the law ought to limit its denunciation to those tho e contracts in restraint of trade that are unreasonable I dont favor any such limitation It seems to be proposed to leave to the judges to decide what com coin combinations combinations and contracts in restraint of trade ought to be permitted to exist and enforced on general grounds of ff f public policy in other words to have bave the court I attempt to establish some line between what are arc called good and bad trusts as asI asif II I if the suppression of competition in some I cass CS s was a good thing and in other cases casesi i was wa bad had I cannot agree that any an such distinction can be properly property made I Punish All Combinations I All combinations to suppress competition I tion don or to maintain a monopoly in whole or in part of interstate trade are and should be in violation of the antitrust law and should be punished as such and andI I there is no room for the expression t reasonable or unreasonable In this gen general general general eral view of the statute The two statutes which must claim c i m the I attention of our congress in its next sea ses session I sion are the Interstate Inter tate commerce law and the antitrust law Ja Another series of questions for con congress gross gress are with reference to the conserva conservation conservation tion lion of resources The Th These I shell not dis din discuss cuss now but bot shall do later in my jour journey journey ney fey The monetary
