Show COURT RULINGS AffECT STRIKE Two Decisions at Helena BearOn Bear on Telephone Trouble in Montana COMPANY GIVES SERVICE BUTTE IS ONLY POINT CUT OFF NOW Every on tile tue s system stem of the ROcky Mountain B BIl ll Telephone company except Butte is now getting service according to a statement made yesterday by A G C Mackenzie publicity agent of the corn com compan pan pany The Situation at Butte has re remained remained unchanged as far as its physical aspect Is concern ea SInce the exchange there was closed more than a month ago agoD agoB D B S Murray Murray general manager of the company compan is still in Montana but he has made malle no announcement as to what may maybe maybe be done with reference to the trouble at Butte Our attitude in Montana Is one In which we have been placed b by the unions themselves said Mr lr Mackenzie The at Butte and the strikes of oper operators atom at other points in n Montana are not due In any measure to grievances but are purely sympathetic We Ve had agreements with the unions at all points affected but the agreements nave bave been broken We have reason to believe that in many instances the girls went out un under under der duress and against their own on wishes All the agreements had been approved by the Montana Montano Federation of Labor Labor People Enjoined Two court decisions at Helena last week have had an important bearing on the situation in the state Following a boycott bocott that had been instituted months ago at Livingston the company began In Injunction injunction junction proceedings in the federal court cort courtat at Helena against the federation and oth othera era em A temporary Injunction was laS granted by Judge Hunt and is now In force In rendering his decision Judge Hunt re referred referred to circulars that had been issued at Livingston advising all persons to withdraw their patronage from the tele telephone telephone phone company and to patronize only certain Lain tain local firms named In the circular lie He said the whole tenor of the circulars lars Fats was calculated and evidently intend intended ed d to injure the business of the telephone compan that It was evident that a corn com combination was formed for the purpose of bo boycotting the company and Injuring its business b by preventing persons from working for It and ruining it as one of f the circulars put it He read deci decisions dons establishing as a proposition of law that laboring people have hare no right to in intimidate or coerce or boycott and that threats or language intended to coerce intimidate or boycott becomes an un unlawful Unlawful lawful Interference with the business He said further that a court of equity would protect all persons engaged In the lawful pursuit of a lawful business whether they were members of labor or or not the they were capitalists or wage earners and that the facts as presented In this case disclosed a clearly unlawful Interference which en entitled entitled titled the com company pan to equitable relief Must Give Service Following this decision the Helena Cab company flied filed in the state district court an application for a writ of mandate to compel the telephone company to give service The application was fas granted by Judge Bach and the company at once es Cs established service at Helena elena using g non l union operators Preference was given to Helena girls and the service there Is Isnow isnow I now good The company compan failed to gi give service only two or three days at Hel Helena era ena The striking operators had an op opportunity opportunity to return to work Judge Bachs ruling required the corn com company pany to resume service It make any difference to the court who refuses to work he be said It make any difference whether people are using force or merely persuasion or how many em cm leave leae the service of the company the defendant has a duty t to perform and It will be and must be performed If there are any efforts made by anybody to prevent the operation of the business I will follow Mr Justice Hunts decision and restrain md punish any anybody anybody body who may interfere with your our lines Thus you see instead of the company making a fight on the unions the fight was brought to us and we had no re recourse recourse course except to establish and maintain service under the conditions as they ex exIsted existed Isted We Ve are doing that and are giving service everywhere except at Butte |
