Show OBJECTIONS TO TOI I PROBA IE OF Will Mrs Herman Oelrichs and Her HerSon HerSon Son Will Fight for Share of Property New York Oct He Helman man Oelrichs of this city today filed an ob objection objection in court to the probate of the will of her late husband Herman Oel Oelrichs Oelrichs richs Her objection is based on the ground that Mr lIr Oelrichs was not a resident of New York but of California Mr Oelrichs left the bulk of his estate to his brother and sisters Mrs Oelrichs son Herman Oelrichs jr through his guardian Paul L Rier Iier nan als also filed an objection to probate the win will on tile the same grounds In an affidavit filed by Mrs Oelrichs she declares that at the time of her husbands death he did not have a res in New York and she has ro no knowledge of information sufficient to form a belief as to whether he died leaving any property in the cit city of New York Mr lIr Oelrichs residence at the time of his death was in San Francisco the affidavit continues and he had property in that state and at the time of decedents decease he be left creditors in the state of California who are no now creditors of his estate and re residing residing siding in that state The affidavit goes on to say that in September Mrs Oelrichs was appointed special administratrix of the estate b by the courts of California and the laws of California are quoted to show that upon the death of a husband of the community property should go to the surviving wife or widow and that the surviving widow cannot be deprived of such interest by testamentary dispo disposition disposition The affidavit declares s that the said Theresa Alice Oelrichs is the surviving widow of the decedent and has had her domicile in California for many years and is therefore entitled to receive one half of the property both real and per personal |
