Charges of falsifying the docket of the Murray justice court were made yester yesterday yesterday ester esterday day in a suit against Charles F Durand the Murray jurist and J P his predecessor The suit is 15 brought against Durand Francis G Luke the Merchants Protective association association association tion and Olina Wathen to restrain them from attempting to collect t a judgment which it is alleged was illegally entered against the plaintiffs who are August Valentine and wife of Brigham City The rhe complaint alleges that Wathen started a suit against Valentine and wife before in July 1903 to replevin thirty head oC ot sheep or recover for their value The sheep had never neer been outside of Box Elder county and the defendants lived in that county count so they filed a de demurrer demurrer on the ground that had no it is charged assumed juris jurls jurisdiction jurisdiction diction arbitrarily and overruled the de demurrer demurrer demurrer Valentine and wife then filed an answer to the suit and the case was tried Oct 7 1903 1003 Luke Instructs I the Court CourtAt At the conclusion of the evidence the complaint alleges expressed the he belief that Wathen had not proven a case Luke who was acting as attorney for Wathen thereupon butted in and sug sOg suggested s g to the court that instead of deciding deciding deciding ing the case Immediately Judge take it under Thomas Blackburn and Lulu B Call as sureties Luke attacked the sufficiency of these sureties and the Valentines then offered the United States Fidelity Guaranty company as surety suret Charge With Fraud Fr ud Then it is alleged refused to accept any undertaking on appeal on the ground that time for appeal had expired In order to make this claim it is charged he deliberately altered his court docket to show that the judgment had been ren dered Oct 7 instead of Oct 13 The Valentines applied to Judge Stew Stewart Stewart Stewart art in the district court for relief Judge Stewart granted a n writ of mandamus compelling to transfer the pa papers papers papers pers in the case to the district court In the district court Luke raised the point that the Valentines had permitted the time for appeal to expire This was overruled by Judge Stewart The com corn plaint does not state what became of this action ultimately Now however it is charged that Luke and Durand who succeeded have pretended to have a judgment en upon Durands docket for against the sureties on the appeal bond Blackburn Call and the bonding com corn pany PY This has been done it is alleged without notice notie to any an of the interested parties It is to restrain the collection of this judgment that the Valentines bring the suit They also ask that the original judgment against them given giyen by b be set
