Show 1 New Trial. It will bo remembered that a few months since, when Associate Justice Emerson was sitting as judge of this district, tho suit of Samuel Smith r c. w..J. fa. Richardson et al. was tried by a jury, who found a verdict for the plaintifls. The suit involved tho ownership of the celebrated Richmond mine, Big Cottonwood. Subsequently Judgu Emerson set. the verdict aside, awarding the properly to the defendants. This occasioned much severe and uncomplimentary comment on the judge's conduct, botn ry mem tiers oi ine oar auu laymen. lay-men. The case has been before the court siute that time on a motion for a new trial, which was granted yesterday yes-terday by his honor Justice Schaefier. TIir chief justice, sets aside the finding, find-ing, ordtr or verdict of his as-ocinte, and permits another trial of the case. The owners ut" the property in dispute, dis-pute, with the exception of one who retains a small interest, have long siuce compromised the difficulty, and are working the mine advantageously. Ouo eflect of Chief Justice SchaefTer'a action yesterday is a strong vindication vindica-tion of the jurors who tried the cuit, and who deeply felt 'the reflection cast upon thorn by Judge Emerson when he set aside their verdict. |
