Be it ordained by the City Council of Salt Lake city, that the W.tti r works constructed by the Corporation to supply S ilt Like city with wrtt-r from City Creek Cifion, shall be designated and known as the Salt Lik.T City Water-works; they shall bo the properly of said city, and shall be under the sole and exclusive! control of the City Council, who may-from may-from time to time direct iLe construction construc-tion of such reservoirs, water tanks, water mains, service pipes and lire hydrants ai the necessities of the in habitants of tlie city may require. The City Council shrill nlw appoint a Superintendent of Wal'T-worss, an Assessor of w:iter rates, and such other otlh'cra as may bo necessary to carry on the works. All officers ho appointed nha!i hold office during the pleasure of said Council. Sec. 2, The Superintendent of Water-works Khali, under the direction direc-tion of the Citv Council, have charge of the rf-servoirs, water tanks, water main?, lire hydrants, and all the machinery ma-chinery and appurtenances appertaining apper-taining to the Water works. He shall have the direction of the laying of wnter maiiii, the putting in of service ser-vice pipes, and the regulation of the water supply to fire hydrants and to all consumers,. Said Water Superintendent, Superin-tendent, befjre entering upon the duties of his office, shall take au oath : -,f nlli.-P. and oivP hntnU with nn- proved security, to Salt Lake city, in the penal sum of $.1,000, conditioned for the faithful performance of his duties. Sec. 0. All hydrants tball bo uuder the control of, and shall be kept iu repair by the Superintendent of the Water works, and in case of fire or fires the Firo Department and such others as the City Council shall authorize, shall have free access to said hydrants. No other person shall open or operate any fire hydrant, or attempt to draw water therelrom. Sec. -i. Any person who shall wilfully wil-fully or carelessly run a vehicle against a fire hydrant, or otherwise wilfully or carelessly injure the Bame, or draw, or attempt to draw water therefrom, shall be subject to a fine of not exceeding one hundred dollars, and be liable for all damages done to said hydrant. Sec. 5. Wrenches for fire hydrants shall be furnished by order of the City Council to the Fire Department, for their use, and to such other persons per-sons as may be deemed proper by tho Council, and any officer or mcuibor ot the Fire Department, or other person per-son having charge of one or more of said wrenches, who shall permit the same to betaken from their place of deposit, or to be used for any other purposes than those authorized by the City Council, shall bo liable to a fiue of not exceeding fifty dollars' ior each oflenso. fc-EC. 6. Whenever any person desires to obtain a supply of w.Uer from the City Water - works, he shall make application therefor, there-for, verbally or in writing, to the Mayor and sigu an agreement that he will be governed by such rules and regulations not inconsistent with this ordinance as may be prescribed by the Mayor for tho control of the water supply; said application must state the location, kind of building, number of rooms, and the entire area of grounds to be supplied, and fully and truly state the purposes for which tho water is to he used; and upon notification from the Mayor, the Superintendent of Water-works is authorized to extend, at the expense of the city, the .oervice pipe to the inside in-side line of the curb stoue.or to within sixteen feet of the properly Hue, at the point most convenient for supplying the premises -of the applicant. Sec. 7. When application is made by a tenant, it must be accompanied by the signature ol the owner of the building or grounds consenting to and authorizing the introduction of water into such premises, and expressly ex-pressly agreeing to the rules and regulations regu-lations embodied in the application land lo the provisions of this ordi-' ordi-' nance. To each service pipe there shall bo attached, at the curb, a stopcock stop-cock and key box, which shall bo paid for by the consumer, and be under un-der the exclu-ivc control of the Su-perin Su-perin tendent. Pec. (J. All service and other pipes used underground shall be of cut iron, extra strong lead or tin-lined lead, and laid not lesi thin four feet below the surface, and all pipes for water supply, whether inside or outside, out-side, shall be of sufficient strength to stand the water pressure, and all such work, alterations or extensions thereof, must he done to the accept-! aoceo! tiie superintendent. But no extension of a consumer's attachments attach-ments shall he made without first obtaining ob-taining a license therefor. Sec. 10. If any water consumer shall permit any person from other premises, or any unauthorized person, to ue or obtain water from said consumer's con-sumer's promises or water fixtures, whether inside or outside of his building, build-ing, the supply of water may be cut oil and the amount paid forfeited. Sec. 11. Sec. 13. Sec. 17. Sprinkling wagons and wai;uns tor the delivery or 6ale of water must be filled from hydrants erected for that purpose, and shall be regulated and controlled by theeuper intendent. Sec. IS Steam boilers will not be allowed to fid Jrom the pipes direct, but must be provided with a tank and supplied therefrom. Sec. 19. Watering troughs for animals will not be allowed a constant tlow of water, but will only bo allowed to use such quantity as will supply the actual wants of the stock having access thereto. Neither will continuous continu-ous streams of water be permitted to flow from hydrants, fauceU or slops oyer washbasins, wator-closets, or urinals, or from any apparatus for drawing water. Sec. 20. Freo access shall at all ordinary hours be allowed to the Superintendent or other authorized person to all places supplied with waler, to examine the apparatus, the amouut used and the manner of using water, ;uid any consumer violating vio-lating any of the rules and regulations regula-tions controlling thb water supply shall forfeit all payments made and the right to the use ol the water. Sec. 21. The City Corporation shall not be held liable for damage to any consumer by reason of a stoppage ,or interruption of his water supply, caused by scarcity of water, accidents to the works or mains, alterations, additions, repairs or other unavoidable unavoid-able cause, beyoud a pro rata reduction reduc-tion on his license during such stop page. Sec. 22. No telegraph post, hitching hitch-ing or other post shall be put down or set within four feet of any water service ser-vice pipe, nor within six feet of any main pipe, except on a written permit per-mit from the Superintendent. I Sec. 23. Wherever the water 'mains arelaid.no person shall be allowed to convey the waters of City ;Creek from any ditch or place by private pipes for fountains, mechani- . cal or other purposes, except the ordinary irrigation of lots, under direction of the Wutermasler, nor shall said waters be hereafter diverted from the ordinary irrigation ditches for the supply ot steam boilers or other mechanism, and all resolutions, ordinances and permits allowing any person to convey the waters of City Creek, or any part thereof from the ordinary ditches by pipes for any use or purpose whatever, wherever the waler mains are laid, are hereby repealed. re-pealed. Sec. 24. It shall be the duly of the Assessor of waler rales to ascertain ascer-tain by measurement, cr estimate, as near as practicable, the amount 01 water ti.xd by each water taker; and he shall make an equitable assess meut thereon, based upon tho rate of ten cents for each one thousand gallons; gal-lons; and no persons shall have the waler conducted to their premises without paying five dollars per annum. an-num. If they consume more than the worth of five dollars they shall pay at lite above "mentioned rates. Said assessment ehall bo made for a term commencing from the time the water is lurmd on to the premises and ending on the 31st day ot March, 1S77, and thenceforth quarterly. The Assessor shall make prompt returns ot" hh doings to the City Recorder, who shall chargo to each person the amount assessed against him, which amount shall be payable on demand and be collected and paid into the City Treasury in the same manner as license fees are collected and paid in. Sec 25. Any person violating any of the provisions of this ordinance, where the penalty is not herein otherwise other-wise provided, shall, on conviction, bo liable to a fiue not exceeding fifty dollars for each oflense. Sec, 2t3. Nothing herein contained j shall prohibit the City Council from ! amending, altering or adding to the j provisions of this ordinance in relation rela-tion to the water supply or the rules and regulations which may he adop-i adop-i ted in conformity therewith; Provided, that no alteration in water rates shall j apply to any license issued or contract made with a consumer under Ibis or-1 dinance, until alter the expiration of such license or contract.
