Ho it imUiued by the City Couucil ofS.ill Like city, tb.it li the Water-works wiwtructwi by the Oororatioii to supply Salt Lake ciiy with witter trom City Creek dm m shall be ilisii-imtotl ami known as the Salt Lake City Wuter-worka; they ahull be the property oTaaid city, and shall be under the sole and exclusive control of the City Council, who may irom time to time direct tlio construc tion of such reservoirs, water ibuks, water mains, service pipes and lire hydrants as the necessities of tho in habitants) of the city may require. The City Council ahull also appoint a Superintendent of Water-worts, an i Assessor of water rates, and such othor officers as may bo necessary to i carry on the works. All officers so appointed shall hold office during tlio pleasure of said Council. Sto. 2. The Superintendent of Water-works shall, under the direction direc-tion of the City Council, have charge of the reservoirs, water tanks, water mains, firo hydrants, and all the machinery ma-chinery and appurtenances appertaining apper-taining to the Water-works. He shall have the direction of the laying of water mains, the putting in of sor-vice sor-vice pipes, and the regulation of the water supply to firo hydrants and to all consumers. Said Water Superintendent, Superin-tendent, before entering upon the duties of his office, shall tako an oath of office and give bonds, with ap- ( proved security, to Salt Lake city, in the peDal sum of $5,000, conditioned for the faithful performance of his duties. He shall report to the City Council quarterly, or oftcner if required, re-quired, his doings as Superintendent, the condition of the W.ilcr works, and mako such suggestions as the nature ol the service may require. Sec. 3. All hydrants shall he under the control of, and shall be kept iu repair by the Superinteadent of tlio Water works, and in case of fire or , fires the Fire Department and such others as the City Council shall , authorize, shall have freo access to said hydrants. No other person shall open or operate any tire hydrant, or attempt to draw water therefrom. Sec. i. Any person who shall wit-fully wit-fully or carelessly run a vehicle against a tire hydraut, ur otherwise wilfully or carelessly iujuro the same, or draw, or attempt to draw water : therefrom, shall be subject to a fine of not exceeding one hundred dollars, and be liable for all damages done to DttlU UJUIIllll. Sec. 5. Wrenches foi fire hydrants shall be furnished by order of the City Council to the Fire Department, for their use, and to such other per-sous per-sous as may be deemed proper by tho Council, and any officer or member I of the Fire Department, or other per-1 ton having charge of one or more of said wrenches, who shall permit the sanio to be taken from their place of deposit, or to he used for any other purposes than those authorized by tho City Council, shall be liable to a fine of not exceeding fifty dollars for each efiense. Sec. G. Whenever any person desires to obtain a eupply of water from the City Water - work3, ; he shall m.ike application there- j for, verbally or in writing, to the Mayor and sign an agreement that he will be governed by such rules and regulations not inconsistent with this ordinance as may be prescribed by the Mayor for tho control of the water supply; said application must state tiie location, kind of building, number of rooms, and the entire area of grounds to be supplied, and fully and truly Btato tlio purposes for which the water is to be used; and upon notification from tho Mayor, the Superintendent of Water works is authorized to extend, at the expense of the city, tho service pipe to the inside in-side line of the curb stone.or to within sixteen fesl of the property line, at the point most convenient for supplying the premises of tho applicant. Ssc. 7. When application is made by a tenant, it must be accompanied by the signature of the owner of the building or grounds consenting to and authorizing the introduction of water into such premises, and expressly ex-pressly agreeing to tho rules and regulations regu-lations embodied in the application and to tlio provisions of this ordinance.' ordi-nance.' Sec. 8. To each service pipe there shall be attached, at the curb, a stopcock stop-cock and key box, which shall bo paid for by the consumer, and he under un-der the exclusive control of the Superintendent. Su-perintendent. Sec. 9. All service and other pipes used underground shall bo of cast iron, .extra strong lead or tin-lined lead, and laid not less than four foet below the surfaco, and all pipes for water supply, whether inside or outside, out-side, shall do of sufficient strength to Btand the water pressure, and all such work, alterations or extensions thereof, must be done to the acceptance accept-ance of tho superintendent. If any water consumer shall permit any person from other premises, or any unauthorized pcrcou, to use or obtain water from said consumer's con-sumer's premises or water fixtures, whether iusido or ouUido of his building, build-ing, the supply of water may bo cut oft and the amount paid forfeited. Sec. U. All persons taking the water shall keep their service pipes, connections, nud other water apparatus appar-atus in goodrepairaud protected from frost at their own expense, but no nprsnn. e xceut under the direction of the Superintendent, shall be allowed to dif into the street, or sidewalk, for the puipoae of laying, removing or repairing re-pairing any seivico pipe. Sec. 1'2. If any consumer shall was to any water, or allow it to be wasted by negligence, such as imperfect imper-fect stops or valves or leaky joints Or pipes, or allowing tanks to ieak or to orcrllow, or wastefully run it through basins or other apparatus, or use the water for purposes other tliau stated iu tho application and license, or in violation of tho rules f and regulations for coutroling the : water supply, and the provisions ol ' this ordiuauce, the water may I cut a oft from such consumer, and all pay ments forlcitcd, unless such person f shall promptly pay such additional charges as may le imposed. Sec. Yi. Whoever, by himself, j family, servants or agents, shall use the water coming through tke water mains without first obtaining a license 1 therefor, or snail without authority ' open any stopcock, valve or other fixture attached to the system of water ' supply, or shall in anywise injure, I deface or impair any part, or any appurtenance of the Water-worts, or shall cast anything into any reservoir or tank of the said works, shall be fined not exceeding one hundred dollars dol-lars for each oflense, or by imprison ment not exceeding six months, or by both fino and imprisonment. If any person, after the water has been turned oft from h:s premises, on aexmntof non-payment of dues, or violation of the ruU sand regulations pertaining to the water supply, shall turn the water on again, or use, or allow the water to he used without authority, ho shall ho fined not exceeding fifty dollars for each oflense. Skc. 15. Fountains and sprinklers for lawns, gardens, yards or sidewalks side-walks shall not bo operated during a tire. Spriuklers for lwiw. gardens, gar-dens, yards and sidewalks must he used only for the purposes expressed in the license; and no sprinkler shall be used for sprinkling tho street outside out-side of tho sidewalk, unless such privilege is included in tho license and paid for accordingly. Sidewalks, windows and fronts shall no, be sprinkled except between tho hours of 6 and S a.m., 1 and 2, and 6 and 8 p.m. No nozzle forepriukling shall ho larger taan one-fourth inch in diameier, and no license lor a sprinkler shall ho issued except in connection with other water service. Sec. 17. Sprinkling wagons aud wagons for the delivery or sale ol water must be filled from hydrants erected for that purpose, and shall be regulated and controlled by thesuper- Sec. IS. Steam boilers will not bo allowed to fill from the pipes direct but must be provided with a tank and supplied therefrom. Sec. 19. Watering troughs for animals will not be allowed a constant Uow of water, but will only be allowed to use such quantity as will supply the actual wants of the stock having access thereto. Neither will continu- ous streams of water be permitted to flow from hydrants, faucets or stops over washbasins, water-closets, or urinals, or from any apparatus for drawing water. Sec. 20. Free access shall at all ordinary hours be allowed to the Superintendent or other authorized person to all places supplied with water, to examine the apparatus, the amount used and tho manner of using water, and any consumer violating vio-lating any of the rules and regulations regula-tions coutroliini; the- water supply shall forfeit all payments made and the right to the use ot the water. Sec. "21. The City Corporation shall not be held liable for damage to any consumer by reason of a stoppage or interruption of his water supply, caused by scarcity of water, accidents to the works or mains, alterations, additions, repairs or other unavoidable unavoid-able cause, beyond a pro rata reduction reduc-tion on his license during such stop pase. Sec. 22. No telegraph post, hitching hitch-ing or other post shall be put down or set within four feet of any water service ser-vice pipe, nor within six feet of aoy main pipe, except on a written permit per-mit from the Superintendent. - Sec. 23. Wherever the water mains are laid, no person shall be allowed to convey the waters of City ( Creek from any ditch or place by private pipes for fountains, mechani cal or other purposes, except the ordinary irrigation of lots, under direction of the Watermaster, nor shall said waters be hereafter diverted from the ordinary irrigation ditches for the supply ot steara boilers or j other mechanism, and all resolutions, ordinances and permits allowing any person to convey the waters of City Creek, or any part thereof from the ordiuary ditches by pipes for any use or purpose whatever, wherever the water mains arc laid, are hereby repealed, re-pealed, j Seo. 24. It shall be the duty of the Assessor of water rates to ascertain ascer-tain by measurement cr ostimats, :is near as practicable, the amount ol water Uiscd by each water taker; and he shall make an equitable assess ment thereon, based upon the rate of I ten cents for each one thousand gal-1 gal-1 Ions; and no persons shall have the water conducted to their premises 1 without paying five dollars per annum. an-num. If they consume more than thfi worth of five dollars they shall I pay at the above mentioned rates. Said assessment shall bo made for a ! term commencing from the time the water is turned on to the promises ' and ending on the 31st dayoi March, 1877, and thenceforth quarterly. The Assessor shall mako prompt returns of his doings to the City Kecorder, who shall charge to each person the amount assessed against him, which amount shall be payablo on demand and bo collected and paid into the City Treasury iu the same manner as license fees are collected and paid in. Sec. 25. Any person violating any of tho provisions of this ordinance, whero tho penalty is not herein otherwise other-wise provided, shall, on conviction, be liable to a fine not exceeding fifty dollars for each oflonse. Sec. 26. Nothing herein contained shall prohibit the City Council Irom amending, alteiing or adding to tho provisions of this ordinanco in relation rela-tion to the water supply or tho rules aud regulations which may be adopted adop-ted in conformity therewith; Provided, that no alteration in water rates shall apply to any licenso issued or contract made with a consumer under this ordinance, or-dinance, until after tho expiration ol such license or contract.
