The Herald editorially edi-torially doubts the story of Jay Gould's private advices that the supreme court has determined to affirm the court of claims' decision in the Union Pacific railway case. Hia ability to puichase such advance information would necessarily involve the favor of sone member of the court. The Htiald believes the story is cunningly doiised for speculative purposes, and characterizes tho Union Pacific as dargcrotiB stock, which doea not represent re-present a dollar of contributed capital, capit-al, and it is only natural that some onois anxious to sell all the Bhares which dupes can be induced to buy. Business men, according to the mercantile agency reports, do not regard re-gard the numerous small , failures thisscason as serious. The belief seems general that the business de-preuion de-preuion has passed .its extreme poict, but the upward movement is beiug experienced bo late in the fall, thatthe anticipated revival is not expected ex-pected before spring. Bsndy do Scbwartzkofl, tobacco dealers, have failed, and will probably prob-ably pay 2-5 cents on the dollar.
