Under the heading ' The Dawn of a New Era in Utah," the San Francisco Chronic'e of Sunday last has an article on Utah affairs, which has about the usual amount of misrepresentations and misconceptions of the real stats of matters here, found in such articles. The second sentence of the article reads : Governor Shaffer has issued two proclamations intended to enforce the laws of the United States, which heretofore here-tofore have been violated with impunity impu-nity by Brighaui Young and his devoted devo-ted Mormons. This it considers "startling," and well it may, seeing the only thing true in it is that Governor Shaffer has issued is-sued the two proclamations. But how about the laws? Those two proclamations aim a direct blow at the laws of the United States and those of the Territory Terri-tory of Utah, in favor of absolutism and the exercise of dictatorial power by the Executive of the Territory; and the issuing of them was undoubtedly part of a well-concocted plot to force the people of the Territory to resist illegal il-legal decrees and thus give a coloring for the often-repeated slander that the citizens of this Territory are at enmity with the laws. Thoe who try to sustain the position of Governor Shaffer in issuing the said proclamations, pretend that the regulations regu-lations adopted by the commission appointed ap-pointed by the Legislature in 1S57, to draft a code far organizing and governing govern-ing the militia of this Territory, are not valid in law. The position thus taken is very weak, childishly weak. But grant it for a moment, and what is tie result? The statute under which that commission a.-ted provides: '"The present laws shall continue in force until superseded as herein provided for.'' Consciuently if thosj regulations regula-tions were not valid we would be compiled com-piled to fall back on the militia law approved December 23rd, IS"-!; under which the Governor of the Territory, and as such commander-in-chief of the :::ili'.ia, has no such appointing powers as those proclamations as-ume. Who, then, is violating the law? Let the ie.irned gentlemen of the 1 mg robe answer. |
