Show THE "HERALD" IVDICT31KXT. Ve-tcrduy we were called upon to plead to the indictment for libel presented pre-sented ntrainst . va, for asking a few luestions about Associate Justice Haw-. Haw-. ley. Mr. Kirkpatriek, one of ourcoun-sel, ourcoun-sel, moved to quash the indictment ; but as the causes on which the motion was based have been recently argued before the court and ruled upon, further fur-ther argument was waived, the point being obtained and the exceptions noted. We were then c il led upon to plead, and pleaded "not guilty" of course. A motion mo-tion was made for continuance, and the proseci.t.ng attorney,. Mr. Heiun-Etead, Heiun-Etead, had no ol jeetion to allow EUch a ''trifling" matter to hold over to the adjourned term, some time in the winter. JHr. Kirkpatnck .took occasion occa-sion to show the learned prosecutor that the matter was not so very trifling, and that evidence had to be obtaiued from a distance, outside the Territory, which would require time to procure. The Court said, as there seemed to be no strong objections to its being continued con-tinued until the next regular term of Court, he would grant the continuance. We feel obliged to the Court for this extension of time, as it will enable us to show fully the undimmed brilliancy bril-liancy of the Associate Justice's lifelong life-long reputation. We expect to make the matter peculiarly interesting to Jadge Ha ley before wo are through. Thanks to the Chief Justice, we have a whole winter in which to do it, and the long evenings will need something to keep away ennui, for if we mistake not the Associate Justice is not much of a patron of those modern abominations abomina-tions known as dancing partie;, and the theatre is seldom honored with his presence. Be assured, dear Judge, we will be indefatigable in laboring to clear up your fair fame. |
