Show x N j 1EPfHTfElT Ogden March 1 WHIPPLE SAYS BOO HOO R I Whipple wants an office and I he wants i badly How badly is suggested I sug-gested by a complaint which he filed yesterday in the Second district court praying that he and not H H Hender son i entitled to the office The logic of the complaint is about as follows I was duly appointed city attorney and duly qualified and served until my time expired Then Henderson was appointed by the mayor He likewise was confirmed and duly qualified He will not give me the office Therefore make him Following is an outline of the com Dlaint Plaintiff alleges That on the 14th day of January 1894 plaintiff was by and with the advice and consent of the city council of Ogden City duly appointed ap-pointed and confirmed the city attorney of said Ogden City that thereupon I said plaintiff duly qualified a tsh city attorney and gave a bond which was duly approved by the mayor of the said city as required by law and thereafter to wit on the 15th day of January 1S94 a commission to said office of city attorney was issued < to this plaintiff by the recorder of the said city under the seal thereof commissioning com-missioning him a city attorney for said Ogden City The complaint further states that Ogden Og-den is a city of the second class and that he entered upon the duties of the office defendant until same was usurped by the The next three sections of the document docu-ment show that H I Henderson was duly appointed by the duly elected and Qualified mayO that he was duly confirmed con-firmed by the council and that his bond was duly made and approved and that his commission was duly executed I exe-cuted and that he commenced the duties du-ties of the said office The next section says that said Whipple asked the said Henderson to I vacate the said office and that said Henderson would not do it Wherefore plaintiff demands judgment judg-ment that the defendant is not enti tied to said office and that he be ousted oust-ed therefrom That plaintiff is entitled to the said office and that he be put into possession of the same |
