Show COURT AT PAROWAN An Important Case Decided Barlovr Ferguson a Jute For an Hour Special to Tho Herald PAROWAN Utah May 16All day yesterday was occupied in Judge Higgins court in the trial of the case of RoweMorrisSummerhays company vs Hewlett Bros and was vigorously fought by Barlow Ferguson for the plaintiff and O H Foster for the defendants de-fendants I was alleged by the plaintiffs plain-tiffs that they received some three years ago a quantity of wool from defendants fendants on commission and paid them 13 cents a pound in advance The wool dropped suddenly in price and it sold in Boston for about 400 less than the advance paid plaintiffs the return of which is now sued for Defendants claim they were guaranteed 13 cents for the wool and all over that it might bring The jury returned a verdict ver-dict for defendants this morningno cause of action This case is one of some importance as there are a great many of a similar kind now pending throughout the state This morning the case of Zephyr K Higgins against Iron county a suit for damages sustained by plaintiff by reason of the death of her husband re suiting from a tipover of his wagon caused by the bad condition of the road came up Judge Higgins was disqualified from hearing the case having been counsel in the same and Barlow Ferguson was called upon to hear the demurrer and try the case i i came to trial He decided that a county was not responsible for the condition of its highways and dismissed dis-missed the action Court adjourned today to convene at Beaver May 22 Judge Higgins leaves today for Salt Lake where he will sitin the supreme court in a case where one of the supreme su-preme judges is disqualified I |
