Show ALLEGED SPOIlS Mamie Ice i til eu Trial Before 17 S Cottimi Iouei Greenman The suits against the three sports Mamie Lee Lou Riley and Mary Doe for vagrancy were called up in United States Commissioner Greenmans court yesterday yester-day afternoon As at the previous hoar ing Attorney Barlow Ferguson appeared to prosecute and the girls were defended by Attorney HI 13 McEneny Attorney 21 E McEneny at the outset asked for a ruling in the matter of a change or venue His honor replied that there were no affidavits for a change of I venue were before the court whereupon Mc Eneny fed affidavits on behalf of Mamie Lee and Lou Rlley asking for a change of venue for the reason that they believed be-lieved they could not have a fair trial on I account of bias and prejudice of tire court I His honor questioned the affiants a to j their reason for supposing they could not get a fair trial and both replied that It was on account of the treatment their attorney had received at the hands of the court on Tuesday when McEnenj was fined 5 for contempt His honor thereupon overruled the motion mo-tion for a new trial Attorney McBneny then objected to Attorney Ferguson appearing in the role of prosecutor for the reason that United States Attorney Judd had no power to appoint Ferguson a assistant United States attorney and that the latter had not Qualified and taken the necessary oath of office The objection was promptly overruled and the hearing of the case against Mamie Lee was proceeded with She demanded a jury trial and a jury was impaneled Detective A E Franks and Officer Gillespie and other witnesses were examined ex-amined for the prosecution when court aflournefl till 9 oclock this morning when the hearing will be proceeded with This will be followed by the case against Lou Riley That agaInst Mary Doc was continued con-tinued until Wednesday next |
