| Show soC TNm iON IN flU1E I INTERESTING SUIT I JUSTICE SOMMEHS COURT E T Stolzenberger Claims Broker A L Morris Didnt Return Antler Shares According to Contract An interesting civil action was tried in Justice Sommers court yesterday morning The plaintiff was E F Stol zenberger and the defendant was Stockbroker Stock-broker A L Morris Mr Stolzenber ger claimed that he had loaned Morris 5000 shares of Antler stock which the latter agreed to return at the end of a week weekhen When the time expired the plaintiff made a demand for the stock but it was not forthcoming He promptlj brought suit for its delivery By way of defense Morris declared that he had been engaged by Stolzenberger to sell Antler stock in such quantities as to break the market price below i of a cent a share In pursuit of this arrangement he proceeded to sell but when the time came for delivery Stolzenberger refused re-fused to produce the certificates Morris Mor-ris therefore asked that the suit be dismissed and that he be given a judgment judg-ment for 258 in damages and 48 commission com-mission After hearing a number witnesses Justice Sommer gave the plaintiff judgment judg-ment for 5 the value of the original 5000 shares and dismissed the counterclaim counter-claim |
