| Show 4 To JOHN WHALOH ANSWERS 1c Mrs Sarah Daft Whalons Suit For Divorce GRAVE CROSS ALLEGATIONS CRIMINAL CASES DISMISSED BY THE COUNTY ATTORNEY Performing a i Prank Carter For Criminal Operation on Evelyn Bonnett Wambolt For Arson and Luke For Perjury Go FreeCases Argued in the Supreme Court V New Suits Commenced and Short Orders Some time ago Mrs Sarah A Daft Whalon commenced divorce proceedings proceed-ings from her husband John H Whalon based substantially on the somewhat novel ground that Mr Whalon had cajoled her into the marriage mar-riage against her will and inclinations It was also set up that the defendant was idle and shiftless and contributed nothing to the maintenance of his wife and that she out of her ample means had to support him while he was not even capable of managing her affairs and looking after her property t prop-erty interests and she had to revoke his authority to act for her Whereupon Where-upon he became morose and cruel and insisted against her will in occupying a room in the Daft block She wanted a decree of divorce and an order of the court restraining him from coming to her residence on West Third South street and also preventing him from Interfering with her property or occupying oc-cupying the room in the Daft building DEFENDANT ANSWERS The defendant yesterday by his attorney at-torney S P Armstrong filed his answer and crosscomplaint in the district dis-trict court in which he denies all the 0 material allegations of the complaint and by way of crosscomplaint alleges that the plaintiff was not tricked into the marriage that she is a person of y mature years and discretion being 4 over 60 and no novice in the marriage business this being her third venture of th kind It is further alleged that Mrs Whalon has not deported herself as a wife should since the marriage trat the defendant transferred to her valuable mining prolerties and gave his time and attention to the management manage-ment of her business affaire with her consv > nt for 15 months after the marriage mar-riage which took place on July 23 1SU5 and that his services were reasonably worth 1COU no part of which has been paid Dtfcndant also alleges that the plaintiff is physically incapacitated from entering into the marriage state and makes some serious charges against her 4 jb In June 1896 for good and sufficient reasons the defendant alleges he cancelled can-celled an insurance policy on his life and over since then Mrs Whalon has abused him used towards him vulgar and profane language sulking and doing everything possible to annoy himHe prays for a decree of divorce that his mining stock be transferred back to him or that he receive its value in cash and that he have judgment for 1500 for his services as business manager for his wife |
