Show Grand C Case is v Entirely F Reopened at Nephi Special to The Herald APRIL 9 This mornings train brought down the usual array of NEPHI t interested In the Grand C mining case Mr Holbrook Brown Henderson anti and represented the Grand Central side while s hue the was represented by Mr re with Judge Zane and ludge Howat Judge Marioneaux opened court at 11 Immediately Judge Zane asked that the motion to open the case for the taking of rebuttal testimony only be lt not wanted granted but that the order made granting gt a new trial remain i T f r f Judge Dickson in iii reply argued that inasmuch as the new trial was granted on that testimony was wan ruled out wh h should hae been fl the court all that was necessary was fo or o eh h the case for that rebuttal testimony The court same judge who tried the case had at this time found that It had erred out certain rebuttal testimony then it could have the case and have admitted that testimony but Bunder tile the cir c the court not be competent to pass upon the case Therefore the order heretofore made granting a new trial must stand Judge Marioneaux leaves for the south tonight and court stands adjourned dj until June 4 next when no doubt this case ase will again be heard r |
