Show I 1 I 1 RIGHTS OF THE BANNOCKS jacksons jackson s hole controversy goes into court representatives of the state and federal government agree to submit two test cases to determine dete smirle whether treaties or state stat laws shall Prevail two fort hall indians will be arrested is cheyenne wyo sept 29 A very satisfactory conference was held here to 1 day by representatives 0 of tile the department 0 of the interior the department ot of justice tile the war department departie depart me nt and the state authorities ot of wyoming upon the incont trouble between the bannock indians and the jacksons Jack bons hole settlers and the prospects are fair as a result that the trouble will be settled satisfactorily t to 0 all concerned the department 0 of the interior was represented in the conference by air provence mccormack McCorm I 1 ick lck indian department cut inspector the department of justice by lion gibson blaik united states attorney for or the district ol 01 wyoming the war department by gen J I J 1 coppinger commanding the department part ment of the platte col schwan of 0 his start staff and col randall handall ot of the eighth eig th united states infantry and the state of f wyoming by governor W r A richards and judge willis acting in the absence 0 of attorney gen oral eral fowler as the governors legal adviser I 1 mr mccormick for his department proposed that there shall be a L test case made and a decision arrived at as to the right of the indians to hunt on public lands unoccupied lands under their treaty either by having an indian arrested by the state officials Is for hunting and an application brought brough t by the united st states ates attorney tor for wyoming for a writ ot of habeas corpus tor for the release ot of sue such I 1 prisoner 8 oner or in so some in e other way and that in case it shall be decided that the indians have a right to hunt and that the laws ot of wyoming are of no effect as against them governor richards nic harda shall by all the means in its his power protect the indians in such buch right and on the other hand it if it should be decided by the courts that thai the indians have no right to hu hunt nt in violation of state laws or in other words that the state laws 0 operate to abridge or defeat their treaty rights then his department to recommend to congress that an agreement be made with them for the relinquishment of the rights guaranteed to them by the treaty of and which they claim and believe are still in abree governor richards Illch ards at once agreed to this proposition and suggested that t two 0 test cases bo be made one charging an indian with killing game within this state during the season in which ot of game Is absolutely prohibited by our state laws the other charging an indian with the killing of game not for immediate use or tor for what Is known as the wanton destruction ot of game by this procedure the extent of 0 the rights of the indians could be tested and the entire matter could be fully settled so that the united states and the state of wyoming may operate cooperate co for the purpose of sustaining and protecting the rights of all affected by state laws whether they be white persons or indians the governor agreed that whatever the final decisions upon the questions might te be he would cheerfully join the officers of the united states in protecting the indians in the enjoyment of whatever rights they may possess and would likewise expect the assistance of the officers ot of the united states in restraining the indians from exercising any asserted rights which they do not have mr mccormick McCorm lck agreed to adopt the suggestions of governor richards Illch ards and will leave here tomorrow tor for the fort hall it reservation where he be will secure two bannock indians and bring brine them to evanston for arrest in accordance with the plan outlined which was put into tile form of a written agreement |
