How soon the electric railways will be put in operation in this city is yet a mystery mys-tery It has been supposed for at least a week that the amended ordinance passed at the meeting of the council prior to las night would meet with favor to all parties concerned but such seems not to be the case as a telegram was received from H M Beardsley at Kansas City by L R Rhodes yesterday instructing him not to accept the franchise as designated in the said amended ordinance Judge Rhodes was heard to remark yesterday I II yes-terday that he was at a loss to know upon wnat grounds Mr Beardsley formed his objections however he had reasons to bs lieve that the clause giving the city Lithe Li-the power to reguate the number of train that tho company shall run daily is whore the difficulty lies The judge thinks the matter can be peaceably adjusted between Mr Beardsley and the council at almos any time should that be the conjuring point He is awaiting further explanations bj letter Hardware Assignment C D Hays who formerly conducted a hardware business on Twentyfourt ah street made an assignment jesterda morning for the benefit of his creditors Mr P A Dillingham is the assignee Mr I Hays has been seriously sick for about two weeks and it is stated for this reason b 6 made this move Mr Dillingham informe a HERALD representative last evening that the liabilities of the house were 3500 and I that it is his belief that the assets will largely exceed the liabilities I Lundy Sentenced The case of the People etc vs R E Lundy charged with grand larceny came up for hearing before Judge A C Bishop yesterday forenoon Lundy is the man arrested ar-rested in Salt Late city a few days ago for stealing elestric fixtures while working in the Grand opera house in this city last December I De-cember Tne evidence produced in the case was not sufficient to show that the value of the stolen property exceeded 50 so tho charge was changed to petit larceny The judge having viewed the case in that light fined Lundy 20 and costs and ten days confinement confine-ment in the county jail United States Marshals Arrest Deputy United States Marshal Chase arrested ar-rested JMatinda Hull at Portage Creek yesterday yes-terday on the charge of fornication She will be arraigned before the First district court this morning In Bealtys Realms The board of directors convened in the rooms of the waterworks franchise ranted to John R Bothwell by a previous c council and that the said Bear Lake and iver Waterworks company has repeatedly iolated the terms of the contract granted s aid1 Bothwell in respect to prices to be barged and collected and attempted to ollect amounts in excess of the amounts a lowed and permitted by said contract that a committee be appointed tl o investigate all matters touch l ng all matters referred to in this contract a s agreed to by said Botbwell or his assigns Referred to the committee on water supply a nd streets Several citizens residing on Twenty bird street protested against the building ot f a sewer on that street giving as a reason that it would not materially benefit them To committee on sewers Joseph McManis J H Bennett and others owning property on Grant avenue between Twentyfifth and Twentysixth treets petitioned for the extension of the ewers in that airection to drain off the surface water which has proved detrimen t al to new buildings in that locality Re ferred to the committee on streets and ewers The petition of C B Anthony was denied I de-nied without reference to a committee Under committee reports the committee on laws reported on the matter of opening thirtieth street recommending that imme iato steps be taken to open said street from the Weber canal to Pacific avenue that taxes for that purpose had been levied and should be collected Referred back to the committee on laws and city attorney with power to act The committee on claims reported recommending recom-mending the payment of a number of bills for sundry matters of purchase and work done including the bill of the Electric Light company for twentynine street lights for last month also recommending thatEA McDaniels claim of 15 be disallowed dis-allowed also referring a number of bills back to the council The report was adopted and the Dills referred to the council coun-cil were ordered paid except the ono of the assistant recorder which depends in some degree upon the decision of the court regarding re-garding the salary grab The report of the committee on lire department de-partment was received recommending the purchase of 2000 feet of rubber hose at SO cents per foot from the Revere Rubber company The recommendation was adopted and the committee ordered to make tho purchase In the petition of last Monday evening askmcr that the water mainsbe extended on Twenty seventh and Twentyeighth streets to Pacific avenue the water supply committee com-mittee reported returning the report of the chief engineer of the water company com-pany saying the mains would soon be run on Twentyseventh but that on Twentyeighth street the income not being sufficient the company could not at present build tho mains The report was placed on file The bids for the printing of the city or dinances in pamphlet form were openedand the contract was awarded to tho Commercial Commer-cial Publishing company on a bid of g150 for 100 copies The other bids ranged from 105 to 5150 Marshal J W Metcalf presented a petition peti-tion asking that L W Tackett be removed from the office of city jailor on account of insubordination in office This petition is i the result of the little episode of last Mon day night in connection with the petition of F W Huff for appointment as police officer and jailor Pending action on the marshals petition and after some little disscussion a motion to adjourn was made but it was lost by a vote < of 5 to 4 Cannon moved that Tackett be discharged dis-charged This caused a long and hot discussion dis-cussion but it was finally carried Elliott moved that Huff be made city jailer and this was debated a lung time Another motion to adjourn being lost Lundy placed Tackett in nomination and the council proceeded to ballot on the nom ination A motion t6 adjourn carried and the council reporters and recorder ad journed j to take lunch with Mr R C Stout the representative of the Revere Rubber
