Show Those Contempt Cases There has been considerable comment on the orders issued by Judge BAETCH in the Third District court in the contempt cases against Sheriff SULLIVAN of Juab county and others in reference to the Utah Milling companys property Thpre were two cases against him First for refusing to turn over to the United States marshal property which he had been ordered or-dered to levy upon by the District Court Second for refusing to turn certain property over to the receiver appointed by the District Court Sullivan was held to be in contempt in both cases In the report of the proceedings before Judge BARTCH it is made to appear that His Honor made two conflicting orders That in the first place he directed the property to be turned over to the marshal mar-shal and in the second place he ordered the same property to be turned over to the receiver This puts the judge in a ridiculous light and the comments upon his rulings have been many and jocular On inquiry it appears that there is no discrepancy between the two orders In the first instance the United States Marshal Mar-shal by his deputies had levied upon the mill of which he took possession and held until ejected by the Sheriffs men That was the property he was ordered to turn over to the Marshal In the second instance there was other property not included in the first order which should bo held by the receiver and it is that which is comprehended in the second order Tne idea therefore that the Judge fell into a trap set for him by the defendants attorneys is a mistake and it will be found that there is no contradiction of orders as they appear of record in the court This explanation is due to the Judge and to the public and should correct cor-rect any impressions that have been formed to the contrary |
