Show PENSION RATES An Important Order Issued by the Commissioner of Tensions The Ajudicatinc and Fixing ol Rates ot PenSions Under tho Act of June ISJO WASHINGTON June toJudge Loch ren commissioner of pensions with the approval of Secretary Hoke Smith has issued the following important order as to adjudication and fixing of rates of pension pen-sion First A claim for a pension under the second section of the act of June 271890 can only be allowed upon proof of mental or physical disability of a permanent character and not a result of claimants own vicious habits incapacitating him from the performance of manual labor in such a degree as to render him unable to earn support Second No specific injury or disability can as such have a pensionable rating under that act nor be considered otherwise other-wise than as it affects the capacity of claimant to perform ordinary manual labor la-bor Third Proof that the disability was not the result ofclaimants own vicious habits hab-its Is requisite therefore the causes and circumstances of the origin of disability should be shown by evidence furnished in support of a claim for a pension so far as can be done and by persons other than claimant Fourth To give claimant pensionable status under this act the disability must be such as to incapacitate him from the performance of manual labor in such a degree as to render him unable to earn support yet the act recognizes differences in a degreeof such pensionable disability giving e12 per month in case of greatest and 6 per month in cases of lowest degree de-gree such pensionable disability rendering render-ing claimant unable t earn support by manual labor It alsqprovides for intermediate ratings proportioned to intermediate degrees of sucapensional disability Proper ratings under this act will therefore be made in accordance with such rules for rating as the medical referee shall prescribe subject sub-ject to the approval of tho commissioner |
