| Show Several Misfits Eiisha M Slocum filed suit for divorce against his wife Margaret Ann Slocum In bis complaint the plaintiff states that on the 30th day of August 1870 he was married mar-ried to the defendant and that some time prior to July 1874 the latter without anj ust or proper excuse abandoned him and left his house since which time they have continued to live neperate and apart that he at once instituted proceedings for divorce di-vorce in the probate court of Box Elder county said court at the time having general gen-eral jurisdiction in matters of divorce ando and-o tlieCth day of February Ib70 obtained what ho supposed was a decree signed bv the probate judge and clerk Recently the discovery has been made that no such decree de-cree as set out in the paper obtained by him was ever made or entered in the divorce di-vorce proceedings also that the court in question never obtained jurisdiction of the person of the defeneant bj any proper or other service summons sufficient in law to pivo it jurisdiction thus making the proceedings pro-ceedings invalid and void The plaintiff further states that relying upon the paper which hoobtained and believing be-lieving it to be a lawful decree of divorce he has since contracted what was supposed to be another marriage and the defendant Margaret M Slocum has since been twice married and Js now living with ono Pin ney Wells whom she believes to be her husband Inasmuch as the defendant is now living in southern Idaho the court ordered publication pub-lication of summons Mette Sophie Christensen ostsd for a decree of iiivorce from her husband Peter Christenceu on the grounds of cruel and inhuman treatment in forcing her to care for six children the family of a deceased plural wIfe notwithstanding the fact that the plaintiff was worn down by overwork and childbearing and tho labor incident to caring for her own family of ovau children child-ren In the complaint the plaintiff alleges that when she protested against the extra duties imposed upon her tho defendant became be-came extremely enraged and in addition to calling her vile and defamitory names struck and beat her with his fists about the head and face thereby causing plaintiff great bodily harm humiliation and distress dis-tress N The plaintiff asks that the bonds of matrimony mat-rimony be dissolved and custody of her children also that a liberal alimony be al owed her |
