the Senate on March 9 nith a simple note of transmission saying I say-ing i had been concluded at Washing I nn on the 17th I is accompanied by t nothing in the way of communication r from Secretary Gresham The treaty 1 is as follows Whereas On the 17th of November A D 1880 and of Kwanghsii the I mh year the tenth month on the 13th day a treaty was concluded between be-tween the United States and China for I the purpose of regulating limiting or suspending the coming of Chinese I laborers t and their residence in the I United States and 1 Whri eas The government of China In view of the antagonism and much I dpr ated and serious disorders to whirl the presence of Chinese laborers has given rise in certain parts of the United States desires to prohibit the emigration of such laborers from China flu the United States and Whereas The two governments de eh Tlrc to cooperate in prohibiting such immigration and to strengthen in many others the bonds of relationship between the two countries and Whereas The two governments are dislrus of adopting reciprocal measures meas-ures for the better protection of the citizens or subjects of each within the jurisdiction of the other nov therefore I there-fore the president of the Unhed States has appointed Walter Q Gresham secretary I sec-retary of state as his plenipotentiary r and his imperial majesty the emperor 1 China has appointed Yang You offler of the second rank subdiiector of the court of sacrificial worship and envoy extraordinary and minister pleni 1 > < entiaiy and the said plenlpoten mrv having exhibited the respective full powers found to be in due forman form-an < l Eoixl faith have agreed upon the following articles Article L The high contracting parties par-ties agree that for a period of ten ° ars beginning with the date of y wih exchange change of artification of this convention conven-tion the coming except under conditions condi-tions hereinafter specified of Chinese laborers shall b absolutely prohibIted itedArticle 2 The preceding articles ehall not apply to the fhal return to the United States of any registered laborer labor-er who has a lawful wife child or parent par-ent in the United States 0 property therein of the value of 1000 or debts of like amount due him and pending settlement nevertheless every Chinese Chi-nese laborer shall before leaving the United States deposit as a condition of his return with the collector of customs of the district from which he departs a full description In writing pf his family or property or debts a flKresald and shall be furnished by said collector with such certificate of his right to return under this treaty a the laws of the United States may hereafter not incon now or hereafer prescribe sistent with the provisions of this treaty and shouldthe written description descrip-tion aforesaid be proved to be false L the right to return thereunder or of j continued residence shall In each case i be forfeited U j3er such subject shall land In the United I Unit-ed States and no such Chinese labpr er shall be permitted to enter the I United States by land or sea without producing to the proper officer of the customs the return certificate herein required Article 3 The provisions of this convention con-vention shall not affect the Ight at present pres-ent enjoyed of Chinese subjects being officials teachers students merchants or travelers for curiosity or pleasure but not laborer of coming to the United States and residing therein To entitle such Chinese subjects as are above described to admission in the United States they may produce a certificate cer-tificate from their government or the government where they last resided I by the diplomats or consular representative repre-sentative of the United States in sf ththC rur j their journey to or from other court I I tries subject to such regulations by i the government of the United States as may be necessary to prevent such privileges of transit from jeing abused i I Article 4In pursuance of article 1 three of the immigration treaty between j be-tween the United States and China signed on the 17th day of November 1880 at Pekin It is hereby understood and agreed that the Chinese laborers or Chinese of any other class either permanently or temporarily residing In the United States shall have for the protection of their persons and property I pro-perty all rights that are given by the laws of the United States to citizens j of the most favored nation excepting j I I the right to become naturalized citizens citi-zens And the government of the I United States reaffirms its obligations 1 as stated in said article 3 to exert all artcle ali its power to secure protection to the I persons and property of all Chinese subjects in the United States Article 5The government of the I United States having by act of Congress Con-gress approved May 1 1892 as amended by the act approved May 5 1893 requiring all Chinese laborers lawfully law-fully within the limits of the United States by the firstnamed act to be registered as in said acts provided with I a view of affording them better protection pro-tection the Chinese government will not object to the enforcement of such i acts and reciprocally the government I I of the United States recognizes the I light of the government of China to i enact and enforce similar laws or regulations regu-lations for the registration free of I chare of laborers skilled or unskilled I un-skilled not merchants as defined by said acts of Congress citizens of the United States in China whether resid lair within or without treaty ports and the government qf the United States 1 agrees that within twelve months of i the date of the exchange and ratification ratifica-tion of this convention and annually thereafter It will furnish to the government gov-ernment of China registers and reports showing the full name age occupation and number of the place of residence of all its citizens of the United States including missionaries residing both within and without treaty ports of China not including diplomatic and other officers of the United States residing in China upon official business together with their body and household house-hold servants Article GThis convention shall remain re-main in force for a period of ten years beginning with the date of the ex change of ratifications and if six months before the expiration of the said period of ten years neither government gov-ernment shall formally given notice of h = tM miiiU > n to the other it shall i emam In Secretary Gresham in conversation with a representative noted that the text of the proposed new treaty with China had been published but he added that it had not been made public pub-lic by the state department The comments com-ments of the public men on the treaty showing the sentiment towards it are apparently being regarded with much interest by him |
